RAM CHAND GUPTA J.(Oral) The present petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.125 dated 18.5.2010, under Sections 458,324,323,506,148,149,427,356 IPC and Section 459 IPC added later on, registered at Police Station City Rajpura, District Patiala. I have heard learned counsel for the parties and have gone through the whole record carefully. It has been contended by learned counsel for the petitioner that he has been continuing in custody since 19.5.2010 and that no injury has been attributed to the present petitioner. Further contended that trial is not likely to be concluded in near future as even the challan has not been filed so far. Further contended that co-accused Davinder Bali @ Kittu has already been granted bail by this Court in Criminal Misc. No.17089-M of 2010. Learned counsel for the State has not disputed these facts. There are no allegations on behalf of the State that the petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Hence, in view of these facts and without expressing any opinion Criminal Misc. No. M-17619 of 2010 -2- on the merits of the case, the present petition for regular bail, filed by petitioner Bindraban Bali is accepted.
