CORAM:- HON'BLE MR.JUSTICE NAWAB SINGH Present: Mr.S.K.Arora, Advocate, for the petitioners. Mr.Jasdev Singh Brar, Assistant Adv. General, Punjab for respondent – State. NAWAB SINGH J.(ORAL) By this petition under Section 482 of Code of Criminal Procedure, the petitioners seek quashing of First Information Report (for short 'FIR) No.70 dated November 25th, 2009, registered under Sections 419, 420, 465, 467, 468, 471/ 120B of the Indian Penal Code (for short 'IPC') in Police Station Sadiq, District Faridkot. By order dated May 31st, 2011, Ritu Bahri, J. directed the parties to appear before the trial Court and the trial Court was directed to record the statements of the parties. In compliance with the same, Judicial Magistrate Ist Class, Faridkot, recorded the statements of the parties, whereby, they stated that they have compromised the matter. Indeed, the dispute between the parties was of personal nature. In view of this, there should not be any impediment in allowing the parties to compromise the matter. Support to this view can be had from the authority 'Madan Mohan Abbot Vs. State of Punjab' 2008 (2) RCR (Criminal) 429, wherein, Hon'ble Supreme Court has ruled that in such type of cases, where the dispute is of personal nature, Court should ordinarily, accept the Criminal Misc. No.M-16221 of 2011(O&M) [ 2 ] compromise. In view of above, petition is accepted. Consequently, FIR No.70 dated November 25th, 2009, registered under Sections 419, 420, 465, 467, 468, 471/ 120B IPC in Police Station Sadiq, District Faridkot and subsequent proceedings arising therefrom, are hereby quashed.
