Mr. Parminder Singh-I, Advocate, for the complainant. ***** RAM CHAND GUPTA, J.(Oral) This is an application for regular bail filed under Section 439 of Code of Criminal Procedure in FIR no. 213 dated 15.03.2012, under Sections 312/315 IPC, and Sections 3/4/5 of Medical Termination of Pregnancy Act, 1971, registered police station City Karnal. CRM No.M-11395 of 2012 2 I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Karnal dismissing bail application filed on behalf of the petitioner. It has been contended by learned counsel for the petitioner that she has been continuing in custody since 28.03.2012 and that trial is not likely to be concluded in near future as co-accused is absconding and investigation has not been completed so far. It is further contended that she was employed as only a Helper by main accused, Dr. Kamlesh. These facts have not been disputed by learned counsel for the State, on instruction from SI Rajeev. There are no allegations on behalf of the State that petitioner is likely to abscond or that she is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of Shakuntla is allowed.
