The Insurance Company is in appeal in a case where the Tribunal found the driving licence produced by the driver to be fake and provided for a right of recovery against the insured. The liability to satisfy the claim even in cases of fake driving licence was considered at length by the Hon'ble Supreme Court in National Insurance Company Versus Swaran Singh (2004) 3 SCC 297, following its earlier decision in New India Assurance Company Versus Kamla-(2001) 4 SCC 342.
