Hon'ble Mr. Justice A.N. Jindal Present: Mr. Gurcharan Dass, Advocate for the petitioner. A.N. Jindal, J The petitioner has invoked the provisions of Article 227 of the Constitution of India for setting aside the orders dated 19.4.2011 and
17.3.2012 passed by the trial court. This court vide order dated 31.5.2012 granted one opportunity to the petitioner-defendant to cross examine PW Sham Lal on the condition that the petitioner would deposit Rs.20,000/- as costs with the Registry of this Court within a period of one week. The learned counsel for the petitioner has produced photo copy of the receipt showing that he had deposited Rs.20,000/- with the Registry on 13.6.2012. The cost was deposited on the extended date (extended by this Court). In the circumstances, this petition is accepted, impugned order is set aside and the trial court is directed to provide one opportunity to the petitioner to cross examine PW Sham Lal. It is made clear that out of the cost deposited with the Registry, Rs.10,000/- would be paid to the plaintiff- respondent for the delay caused in cross examination and the remaining amount of Rs.10,000/- would go to the Legal Aid Services Authority, Chandigarh.
