The saidagreement provides for the resolution of disputes through arbitration. Clause172 of the agreement pertains to dispute resolution through arbitration and isreproduced below for ready reference:"172.If any dispute arises and persists between the Contractorand the Employer the same shall be referred to an Arbitrator appointedby Shri Saibaba Sansthan Trust, Shirdi, under the Arbitration andConciliation (Amendment) Act 2015 and the Arbitration andConciliation Act 1996."3.The learned Counsel for the applicant further submits that certaindisputes have arisen between the parties.
The applicant invoked thearbitration clause by issuing a notice dated 13/10/2025 to the respondent.However, the respondent failed to respond to the said notice. In thesePage 1 of 2 910 Arb Appln 2-2026 circumstances, the present application is filed under Section 11 of theArbitration and Conciliation Act, 1996, seeking appropriate relief.4.Issue notice to the respondent, returnable on 10/04/2026.
