Judgment

HON'BLE NALIN KUMAR SRIVASTAVA, J.

Learned counsel for the applicant and learned A.G.A. for the State are present.

Shri Om Prakash, advocate also appeared before the Court on behalf of opposite party no.2 and requested for grant of some time to enable him to file vakalatnama / reply in the Registry.

Present Anticipatory Bail Application has been filed with the prayer to grant anticipatory bail to the applicant- Sandeep Yadav in Case Crime No. 321 of 2025, under Sections 105, 318(4), 3(5) of BNS and Section 34(2) of the National Medical Commission Act, 2019 Police Station - Gagaha, District - Gorakhpur.

It is submitted by the learned counsel for the applicant that the applicant is innocent and has no concern with the present matter. Allegations levelled in the matter are general in nature. It is further submitted that earlier the applicant had been granted protection by the Division Bench of this Court in Crl. Misc. Writ Petition No. 12018 of 2025 by order dated 3.7.2025 and the said liberty was never misused by him. If the applicant is enlarged on bail, he will not misuse the liberty and will cooperate with the investigation/trial. The applicant has apprehension of his arrest by the police any time.

Learned A.G.A. opposed the prayer.

Three weeks' time is granted to the opposite parties to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week after.

As an interim measure, till the next date of listing, the applicant is granted interim anticipatory bail in the aforesaid case crime number. In the event of arrest of the applicant, he shall be released on anticipatory bail on his furnishing a personal bond of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall make himself available before the court concerned on the date fixed in the matter; (ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him / her from disclosing such facts to the Court or to any police officer; (iii) The applicant shall not leave India without the previous permission of the Court and if he has passport, the same shall be deposited by him before the S.S.P./S.P. Concerned.

In case of default of any of the conditions, same may be a ground for cancellation of interim protection granted to the applicant.
