On a query being made to learned counsel for applicants as to why after more than four years applicants had approached this Court, learned counsel for applicants submits that when the summons were served then applicants have come to the Court.
On a further query being made to learned counsel for applicants as to when summons were served and in this respect where is the averment in the pleadings, learned counsel for applicants could not demonstrate any paragraph in the affidavit to show that there is any averment with regard to date of service of summons.
In view of the fact that applicants have come after more than four years before this Court, ex parte stay cannot be granted.
Accordingly, the stay application is rejected.
