Learned counsel for the applicants on instructions submits that though the application has been preferred to quash summoning order dated 03.10.2024 passed by learned Special Chief Judicial Magistrate, Agra including entire Criminal Proceedings in Case no 36/2019 and complaint case No 5665/ 2019 Under Section 227(3) (d) read with section 233 of the Companies Act 1956 of Police Station New Agra, Distt. Agra, however, he confines his relief for compounding under Section 441 of the Indian Companies Act, 2013.

Learned A.G.A. has no objection to the same.

Considering the submissions raised at the Bar, the application stands disposed of granting liberty to the applicants to prefer appropriate proceeding for compounding under Section 441 of the Indian Companies Act, 2013 and in case such proceeding is preferred before the court concerned, then this Court has no reason to disbelieve that the same shall be decided with most expedition strictly in accordance with law.
