Judgment

Heard Sri Lakshmi Kant Singh, learned counsel for the applicants, Sri Santosh Kumar Pandey, learned counsel for opposite party no. 2 and Sri K.K. Tripathi, learned AGA-II for the State.

This application has been filed to quash the charge sheet dated 15.2.2023 and cognizance/summoning order dated 19.2.2025 as well as entire proceedings of Case No.9457 of 2025, arising out of Case Crime No.39 of 2023, under Sections 498A, 323, 504, 354, 494 IPC and 3/4 D.P.Act, Police Station-Bilari, District- Moradabad, pending in the court of Additional Chief Judicial Magistrate, Court No. 1, Moradabad.

Facts giving rise to the present controversy is the matrimonial discord between applicant no.1 and opposite party no.2 has culminated into the impugned proceeding, which is under challenge.

Learned counsel for the applicants and learned counsel for opposite party no.2 have jointly submitted that parties have settled their dispute amicably and their matter was referred to the Mediation Centre vide order dated 17.3.2025. In pursuance of that order, parties have appeared before the Mediation Centre and settlement agreement dated 23.3.2025 has also been entered into between the parties. As the dispute between the parties has already been settled through mediation centre and settlement agreement dated 06.05.2023 has also been entered into between them wherein parties have decided to terminate the proceeding including the impugned proceeding against each other. Thus, in view of the well settled principles of law as laid down by the Hon'ble Apex Court reported in 2003(4) SCC 675 (B.S. Joshi Vs. State of Haryana), J.T. 2008(9) SC 192 (Nikhil Merchant Vs. Central Bureau of investigation and another), (2012) 10 SCC 303 (Gian Singh Vs. State of Punjab), (2014) 9 SCC 653 (Yogendra Yadav and others Vs. State of Jharkhand) and also (2014) 6 SCC 466 (Narendra Singh Vs. State of Punjab), and in view of the settlement agreement dated 06.05.2023, the proceeding of the aforesaid case is hereby quashed.
