Judgment
Heard learned counsel for the petitioner.
By means of the present petition filed under Article 227 of the Constitution of India, the petitioner has sought the issuance of a direction to the Civil Judge, Senior Division, Unnao to decide Civil Suit No.83 of 2023 (Iqbal Khaliq Vs. Asif Khaliq) pending before him, expeditiously.
Keeping in view the nature of the relief sought and order proposed to be passed, issuance of notice to the respondents is hereby dispensed with.
The learned counsel for the petitioner has submitted that although, there is no order of temporary injunction operating against the petitioner but the mere pendency of the suit is causing prejudice to the petitioner as the respondent-plaintiff has no locus standi to file the suit. The petitioner has filed written statement on 22.05.2024 and trial of the suit is yet to begin. The petitioner has not filed any application under Order VII Rule 11 of CPC, in which, the suit can be rejected.
It is matter of common knowledge that all the courts and tribunals are dealing with immense work load with numerous older matters being pending in consideration of all the courts, therefore, no direction can be issued at this stage for earlier disposal of matter filed in the year 2023, in which, no temporary injunction has been passed against the petitioner. 2 A227 No. 7025 of 2025
