Heard learned counsel for the petitioner, learned counsel for the respondent and learned A.G.A. for the State respondents.
The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 07.01.2025 registered as Case Crime No.10/2025, under sections- 419, 420, 467, 468, 471 of IPC, Police Station- AIIMS, District - Gorakhpur, and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report.
The F.I.R has been lodged by the Lekhpal of the Tehsil concerned alleging that the petitioners are giving possession on land to purchasers on land which is subject matter of ceiling proceedings instead of giving possession over their land.
Learned counsel for the petitioners submits that the persons aggrieved, have not approached the police station or before any competent legal forum. F.I.R. has been lodged by Lekhpal on account of ulterior motives.
