1. Heard Sri Shiv Sharan Tripathi, learned counsel for the petitioner as well as Sri Ratan Singh, learned AGA appearing for the State respondents and perused the record.

2. Present petition has been filed challenging the impugned FIR dated 29.7.2024, registered as Case Crime No. 390 of 2024, under Section 2/3 U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, P.S. Harduaganj, District Aligarh.

3. Submission of the learned counsel for the petitioner is that the gang chart has been prepared in violation of provisions of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 and the Rules framed thereunder. It was contended that Rule 5(3)(Ka) and Rule 10(1), 17(1) of the Rules, 2021 have not been complied with. In support his arguments, learned counsel for the petitioner has placed reliance on the judgements rendered by this Court in Criminal Misc. Writ Petition No. 14127 of 2024 (Shivam Yadav vs. State of UP and 2 others) dated13.9.2024 and Criminal Writ Petition No. 15100 of 2024 (Sonu Singh @ Sumit Kumar Singh vs. State of U.P. and 3 other) dated 18.9.2024 and Criminal Misc. Writ Petition No. 13495 of 2024 (Lukman Ahmad vs. State of U.P. and 2 others) dated 10.9.2024 wherein in all the cases gang chart were quashed and the authority concerned was set at liberty to initiate fresh proceedings under the U.P. Gangster and Anti Social Activities (Prevention) Act, 1986.

Sri Ratan Singh, learned AGA appearing for the State respondents, on instructions, has produced the copy of advice of Joint Director Prosecution, Aligarh dated 4.7.2024 under the signature of Joint Director Prosecution addressed to the Superintendent of Police (Rural), Aligarh and has fairly pointed out that there are certain irregularities in preparation of the gang chart, which have been highlighted in the instructions dated 4.7.2024 (which is taken on record), contents whereof is quoted under: "ककारकार्यालर ससंरयकसं ननिददेशक अनभिरयोजनि , जनिपद - अललीगढ़। पतकासंक- अललीगढ़ /नवि०अनभि०/2024/68 नदनिकासंक 04.07.2024 सदेविका मम, पयललस अधलीक्षक गकामलीण, जनिपद अललीगढ़। नविषर- गगगललीडर मयकदे श कय मकार पयत विकासयददेवि लससंह ननिविकासली गकाम ककोंडरका थकानिका हरदयआगसंज जनिपद अललीगढ़ वि उसकदे सहअनभिरयकगण कदे नविरूद्ध प्रस्तकानवित नगरयोहबन्द अलधननिरम कक ककारर्याविकाहली मम गगगचकारर्या अनियमयोदनि नकरदे जकानिदे कदे सन्दभिर्या मम नविलधक अनभिमत- महयोदर, कक परका उपरयोक नविषरक अपनिदे ककारकार्यालर पत ससंख्रका -एसपलीआर-विका०-14/2024 नदनिकासंक

15.06.2024 कका सन्दभिर्या गहण करनिदे कका कष्ट करम , लजसकदे दकारका प्रभिकारली ननिरलीक्षक थकानिका हरदयआगसंज दकारका गगगललीडर तथका इसकदे ससंगनठित नगरयोह कदे सनक्रिर सदस्रसं कदे नविरूद्ध उ०प्र० नगरयोहबसंद एविसं समकाज नविरयोधली नक्रिरका कलकाप ननिविकारण अलधननिरम 1986 कक धकारका 2/3 गगगस्रर एक्र कदे अन्तगर्यात ककारर्याविकाहली नकरदे जकानिदे हदेतय ततैरकार गगगचकारर्या पर गगगस्रर एक्र कदे अन्तगर्यात ककारर्याविकाहली नकरदे जकानिदे कदे सम्बन्ध मम आप दकारका नविलधक अनभिमत चकाहका गरका हतै। मदेरदे दकारका गगगचकारर्या वि गगगचकारर्या मम असंनकत अनभिरयोगकों कक ससंलग्न प्रथम ससूचनिका ररपयोरर्या , आरयोप पत वि अन्र प्रपतकों कका पररशलीलनि सम्रक अध्ररनि कर उत्तर प्रददेश शकासनि गकह (पयललस) अनियभिकाग-9 कदे पत ससंख्रका -5203(ए)/छछ-पय०-9-2021-31 (43) 2013 रलीसली लखनिऊ नदनिकासंनकत 27 नदसम्बर 2021 कदे दकारका उ०प्र० नगरयोहबन्द समकाज नविरयोध नक्रिरका कलकाप (ननिविकारण) अलधननिरम 1986 कदे दयरूपरयोग रयोकदे जकानिदे कदे सम्बन्ध मम ननिगर्यात नदशका - ननिदरश कदे आलयोक मम नविलधक परलीक्षण नकरका गरका। गगगचकारर्या मम ननिम्निलललखत कनमरकासं हग , लजनिकक पसूनतर्या गगगचकारर्या कदे अनियमयोदनि कदे पसूविर्या नकरका जकानिका आविश्रक हतै। 01- गगगचकारर्या कक लजस्र मम उक तथ्र कका असंकनि नकरका जकानिका आविश्रक हतै नक गगगललीडर दकारका अपनिदे गगग कदे सदस्रकों कदे सकाथ नमलकर आपरकालधक कक त्रकों कयो ककाररत करकदे आलथर्याक , भिभौनतक वि दयननिरकाविली लकाभि प्रकाप्त नकरका जका रहका हतै। 02- गगगचकारर्या कक लजस्र मम स्पष्ट रूप सदे असंनकत नकरका जकानिका आविश्रक हतै नक गगगललीडर वि उसकदे सहअनभिरयकगण दकारका ककाररत अपरकाध जयो गगगचकारर्या मम दनशर्यात नकरदे गरदे हतै विह नगरयोहबन्द अलधननिरम कक नकस धकारका सदे आच्छकानदत हतै। उक प्रकरण मम रह धकारका 2 खण्ड (ख) कदे उपखण्ड (एक) कदे आच्छकानदत हतै। 03- गगगचकारर्या कक लजस्र मम रह भिली असंनकत नकरका जकानिका आविश्रक हतै नक गगगचकारर्या मम दनशर्यात अनभिरयोगकों मम गगगललीडर वि अन्र गगग सदस्रकों कदे नविरूद्ध आरयोप पत मका० न्रकारकालर प्रदेनषत नकरका जका चयकका हतै। 04- गगगचकारर्या कक लजस्र मम रह भिली असंनकत नकरका जकानिका आविश्रक हतै नक गगँगचकारर्या मम दनशर्यात अनभिरयोगकों कदे आधकार पर जनिपद कदे नकसली अन्र थकानिदे सदे गगगचकारर्या निहहीं बनिकारका गरका हतै। अतछ उपरयोक कनमरकों कक पसूनतर्या कदे पश्चकात हली गगँगचकारर्या कदे अनियमयोदनि हदेतय नविलधक अनभिमत नदरका जकानिका समलीचलीनि हयोगका। भिविदलीर प्र० ससंरयक ननिददेशक अनभिरयोजनि, अललीगढ़।"

5. That apart, on perusal of the gang chart, we find that the authority concerned has signed the gang chart on pre-printed proforma and they have not put any date thereon. We, therefore, find that the judgement rendered by this Court in Shivam Yadav (supra) applies to this case as well.

This Court in the case of Sanni Mishra @ Sanjayan Kumar Mishra vs. State of U.P. and others reported in2024 (1) ADJ 231 (DB). has observed that signing pre- typed satisfaction amounts to violation of Rule 17(2) of the U.P. Gangster and Anti Social Activities (Prevention) Rules, 2021 (hereinafter referred to as 'Rules, 2021') and non application of mind on the part of the competent authorities. Paragraphs No. 16, 17, 18 and 19 of Sanni Mishra (supra)case is quoted as under:- "16. Rule 17 of the Gangster Rules, 2021 further provides that competent authorities, before forwarding the gang-chart must apply an independent mind to the information mentioned in the gang-chart as well as evidence annexed therewith. Rule 17(2) of the Gangster Rules, 2021 further provides that pre-printed rubber seal gang-chart should not be signed by the competent authorities because the same shall amount to not exercising independent mind. Rule 17 of the Gangster Rules, 2021 is being quoted as under: "17. Use of independent mind.-(1) The competent authority shall be bound to exercise its own independent mind while forwarding the gang-chart. (2) A pre-printed rubber seal gang-chart should not be signed by the competent authority; otherwise the same shall tantamount to the fact that the competent authority has not exercised its free mind."

The purpose of prohibiting the signing of pre-printed rubber seal under Rule 17(2) of the Gangster Rules, 2021 is to bind the competent authorities to apply independent mind by mentioning their satisfaction in clear words. Therefore, signing the pre-typed satisfaction will also be prohibited under Rule 17(2) of the Gangster Rules, 2021.

18. In the present case, all the competent authorities simply signed just below the printed proforma regarding their satisfaction. Therefore, it clearly violates Rule 17 of the Gangster Rules, 2021.

This court is also of the view that while forwarding and approving the gang-chart, it is the duty of the competent authorities to see whether gang- chart has been prepared as per the Gangster Rules, 2021 and all the formalities as required by the Gangster Rules, 2021 have been fulfilled. If from the record, it appears that competent authorities forwarded or approved the gang-chart without looking into the facts that the gang-chart was itself not prepared as per the Gangster Rules, 2021, then this fact will itself amount to non-application of independent mind on the part of competent authority."

7. Pursuant to the judgement of this court in Sanni Mishra (supra), the Director General of Police has issued a circular dated 19.01.2024 for compliance of the direction issued by this court. Subsequently, the Government has also issued circular dated 21.01.2024 for compliance of the direction issued by this court.

8. From the above analysis, it is clear that the gang chart of the impugned F.I.R. itself is prepared in violation to the Rules, 2021 as well as the direction issued by this Court in Sanni Mishra (supra) case. Therefore, the gang chart as well as the impugned F.I.R. are liable to be quashed.

9. As this Court is entertaining the present petition only on the technical ground, therefore, instead of keeping the petition pending, the petition is being finally disposed of by quashing the impugned F.I.R. as well as gang chart.

10. Accordingly, present writ petition stand s allowed. The impugned First Information Report dated 29.7.2024, registered as Case Crime No. 390 of 2024, under Section 2/3 U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, P.S. Harduaganj, District Aligarh as well as the gang chart are hereby quashed so far as petitioner is concerned.

However, the authority concerned is at liberty to initiate fresh proceedings under the Gangsters Act after preparing the gang chart of the impugned F.I.R. as per the Rules, 2021 as well as in view of the direction issued by the Division Bench of this Court in Sanni Mishra (supra).
