The record indicates that applicant hadissued the legal notice to the non-applicant by invokingthe provisions under Section 11(6) of the Arbitrationand Conciliation Act, 1996. Non-applicant hadresponded to the said notice on 15th June, 2024.Therefore, the presumption is that the non-applicant isSKNair 218-mca-441-25.odtduly aware of the present application under Section11(6) of the Arbitration and Conciliation Act, 1996.
In light of the facts and continued absenceof the non-applicant, despite the service of notice, this Court is constrained to proceed exparte against the non-applicant.
