Heard Sri Anil Kumar Pandey, learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1 and 2. The present writ petition has been filed challenging the award of the Permanent Lok Adalat dated 23.7.2024 passed in PLA Case No.1 of

#2021. It is contended by learned counsel for the petitioner that the respondent no.3 was the owner of motorcycle No. UP14CL4316, which was insured with the petitioner company with compulsory personal accident cover. In pursuance of an accident, which took place on 3.7.2020, the respondent no.3 was injured. It is contended by learned counsel for the petitioner that a specific ground was taken before the Permanent Lok Adalat that regarding the same incident, the respondent no.3 has filed MACP No.102 of 2020 claiming compensation for third party. He has also filed a medi- claim. Therefore, the application before the Permanent Lok Adalat was not maintainable in view of the provisions of Section 22-C(2) of the Legal Services Authority Act, 1987. The other point argued by learned counsel for the petitioner is that under policy of subrogation, the respondent no.3 has already received compensation as a third party from one insurance company, so he could not claim a fresh compensation from the petitioner. Matter requires consideration. Issue notice to respondent no.3 returnable at an early date. Steps be taken within a week by registered/speed post. 2 WRIC No. 41966 of 2025 All the respondents may file counter affidavit within six weeks. Rejoinder affidavit, if any, may be filed within two weeks, thereafter. List thereafter. Till the next date of listing, no coercive action shall be taken against the petitioner in pursuance of award dated 23.7.2024, provided the petitioner deposits the entire amount before the Permanent Lok Adalat, which shall be invested in an interest bearing account, and shall be subject to further orders being passed in the present writ petition.
