Judgment
Heard Sri Pramod Kumar Singh, learned counsel for the petitioner, learned Standing Counsel for State-respondents.
The petitioner has preferred the present petition inter alia with the following prayers:- "I. issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 Deputy Labour Commissioner, Gorakhpur to made a reference about the claim of the petitioner and sent it before the learned Labour Court for deciding the claim of the petitioner according to the representation dated 05.12.2024."
It is argued that by learned counsel for the petitioner that though representation in this regard made by the petitioner before Respondent no. 2 namely Deputy Labour Commissioner, Gorakhpur on 05.12.2024 but till date no decision has been taken in the matter. Hence the present petition.
Sri Jamal Ahmad Khan, learned counsel who is present in the Court was requested to assist the Court in the matter, he is pleased to accept the prayer as made by the Court and go through the averments made in the present petition. It is argued by him that as per Section 2-A of the Act 1947, the workmen would submit an application before the Conciliation Officer and only, thereafter, he will do the needful in the matter.
Heard Sri Pramod Kumar Singh alongwith Sri Jamal Ahmad Khan, learned counsel for the petitioner as well as learned Standing Counsel on behalf of State respondents and perused the record.

In the facts and circumstances of the case, the present petition is disposed of permitting the petitioner to file a application as per Section 2-A of the Act 1947. In case, such an application is filed, the authority concerned will take a decision in the matter most expeditiously and preferably within a period of six weeks' from the date of submission of application.
