Judgment
"Heard learned counsel for the parties. It is alleged that though the private dispute between the parties are pending before the civil court yet the police personnel arrested the petitioner and after he was put in lockup, possession over the petitioner's land has been got delivered to the private respondents. In the facts of the case, we permit the learned Standing Counsel to obtain instructions in the matter. Put up as fresh, once again, on 25.03.2025." Learned Standing counsel has obtained instructions according to which as there was dispute and peace was threatened, as such proceedings under Section 107/116 Cr.P.C. were undertaken. It is also stated that the police authorities are not taking sides in the matter. Copy of the instructions are furnished to learned counsel for the petitioner and they are also taken on record. In view of the stand taken by the respondents, it would be appropriate to dispose of this petition with the observation that the private dispute between the parties would be got resolved by the competent civil court. The police authorities shall not take sides and their intervention would be limited to preservation of peace at the spot. Order Date :- 8.4.2025 RA
