Judgment

Heard learned counsel appearing on behalf of the petitioner and the learned Standing Counsel appearing on behalf of the State respondents.

This is a writ petitioner under Article 226 of the Constitution of India wherein the writ petitioner is seeking the following substantial reliefs: "i. issue a writ, order or direction in the nature of certiorari for quashing the impugned order dated 05.02.2025 passed by the respondent no.2 whereby declined to issue character certificate to the petitioner. ii. issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to consider the grievance of the petitioner for issuance character certificate in his favour. "

Upon hearing counsel appearing on behalf of the parties, we are of the view that the petitioner should approach the Divisional Commissioner concerned by way of filing a proper application/representation, which should be decided by the said authority.

Operative part

Accordingly, the writ petition is disposed of with a direction upon the petitioner to approach the Divisional Commissioner concerned by way of filing the proper application/representation within two weeks from date. In the event such an application/representation is filed, the Divisional Commissioner concerned shall decide the same within a period of eight weeks from the date of filing of the said application/representation in accordance with law, after affording opportunity of hearing to the petitioner.
