Judgment

Heard Mr. Alok Kumar Sharma, learned Advocate holding brief of Ms. Nishi Sengar, learned counsel for the petitioners and Mr. Sanjay Kumar Ray, learned Standing Counsel for the State respondents.

By means of instant writ petition, the petitioner is seeking a writ in the nature of mandamus commanding respondent no.2 to decide the application under Section 42-A of U.P. Consolidation of Holdings Act, 1953 within short span of time as may be fixed by this Court.

This Court vide order dated 12.12.2025 directed Counsel for the State to seek instructions why application under Section 42-A of the Act, 1953 has yet not been registered despite there being report dated 27.04.2019, which has been appended as Annexure No.2 to the writ petition.

Today, State Counsel has apprised that despite sending letters twice on

04.01.2026 and 27.01.2026 no one has responded. Such attitude of Consolidation Officer in not responding to the letters of State Counsel is an apathetic attitude towards dispensation of justice and is causing hindrance in proceedings of this Court.

For the reasons stated above, this Court takes serious view of the matter, let personal affidavit of Consolidation Officer, Sadar, Aligarh, before whom the application under Section 42-A of the Act is pending, be filed within two weeks explaining the reason for not registering the application and not responding to the letters sent by the State Counsel through fax. 2 WRIB No. 5154 of 2025

In the event of failure to file personal affidavit, the Consolidation Officer, Sadar, Aligarh shall appear before this Court on the next date fixed.

List this matter on 25.05.2026 as fresh.

In the meantime, it is open for the Consolidation Officer, Sadar, Aligarh to decide the application filed by the petitioners under Section 42- A of the Act strictly in accordance with law, after putting all stakeholders to notice if there is no legal impediment and the application is also otherwise maintainable.
