1. Pursuant to the order of this Court dated 11.3.2025, the Settlement Officer of Consolidation had reached the site of Plot No. 1090 and in presence of the petitioners, demarcated the area as per the proposed ‘Jot’

specified in ‘Form 23’ that is enclosed on age 21 of the writ petition. However, it is the petitioners, who refused to take possession of the site.

2. When the matter was last listed on 21.3.2025, the following order was passed:-

1. In compliance of the earlier order of this Court, report/instruction dated 19.3.2025 sent by Settlement Officer of Consolidation, Baghpat is already on record of the instant petition.

2. In the report / instruction dated 19.3.2025, reason has been assigned for not delivering the possession to the petitioner adjacent to plot no. 1090.

3. Counsel for the petitioners is disputing the facts mentioned in the report/instruction dated 19.3.2025.

4. Counsel for the petitioner is directed to file reply to the facts mentioned in the report/instruction dated 19.3.2025.

5. Put up this matter as fresh on 7.4.2025.

3. Today, learned counsel for the petitioners again seeks adjournment to enable him to complete his instructions. This Court finds that in proceedings for allotment of chak without availing of remedies provided to under the Consolidation of Holdings Act, the petitioners had rushed to this Court in the writ petition.

Now, as per the instructions received by the learned Standing Counsel by means of letter of Settlement Officer of Consolidation, Baghpat dated 19.3.2025, it appears that the Settlement Officer of Consolidation had complied the aforesaid order dated 11.3.2025, passed by this Court. The instructions so received are as under:- "प्रेषक, बन्दोबस्त अधि(cid:14)कारी चकबन्दी, बागपत। सेवा में, स्थायी अधि(cid:14)वक्ता, मा० उच्च न्यायालय, इलाहाबाद। संख्याः-469 पे०का०-चक०/2024-25, दिवषयः- मा० उच्च न्यायालय इलाहाबाद में योजि)त रिरट याधिचका संख्या-535/2025 मोहनपाल सिंसह व अन्य बनाम उत्तर प्रदेश राज्य व अन्य में पारिरत आदेश दिदनांक 11.03.2025 की अनुपालन आख्या का प्रेषण। महोदय, दिदनांक-19.03.2025 कृ पया उपरोक्त दिवषयक याधिचकाकता5गण श्री मोहनपाल सिंसह पुत्र ग)े सिंसह, व अन्य दिनवासीगण ग्राम बामनौली परगना बरनावा तहसील बड़ौत जि)ला बागपत द्वारा मा० उच्च न्यायालय इलाहाबाद में योजि)त याधिचका संख्या -535/2025 श्री मोहनपाल सिंसह व अन्य बनाम उत्तर प्रदेश राज्य व अन्य का सन्दर्भ5 ग्रहण करने का कष्ट करें, जि)समें मा० उच्च न्यायालय इलाहाबाद द्वारा दिदनांक 11.03.2025 को दिनम्नवत आदेश पारिरत दिकये गये हैंः- “In view of the said statement, let the first petitioner reach the site of Plot No. 1090 of village Bamnauli, Tehsil Bdaut, District Baghpat on 18.3.2025 at 11 am when the Settlement Officer of consolidation, Baghpat would deliver possession to him after necessary measurement and demarcation and submit a report to this court on or before the next date scheduled.” 1- उपरोक्त आदेशों के अनुपालन में इस काया5लय के पत्र संख्या -430/पे०का०- चक०/2024-25 दिदनांक 17.03.2025 के द्वारा चकबन्दी कार्मिमकों की टीम बनाते हुये याधिचकाकता5 श्री मोहनपाल सिंसह पुत्र ग)े सिंसह दिनवासी ग्राम को मौ)ा बामनौली के गाटा संख्या-1090 की पैमाईश कराकर कब्)ा दिदलाने हेतु दिदनांक 18.03.2025 दिनयत की गयी। 2- उक्त दिनदEशों के अनुपालन में सहायक चकबन्दी अधि(cid:14)कारी स्तर से प्रर्भादिवत पक्षों सदिहत याधिचकाकता5 एवं चकबन्दी कमेटी को दिवदिव(cid:14)वत सूचना )ारी की गयी। दिन(cid:14)ा5रिरत दिदनांक 18.03.2025 को चकबन्दी कार्मिमक पया5प्त संख्या में पुलिलस बल के साथ मौ)ा बामनौली के गाटा संख्या-1090 की पैमाईश हेतु उपस्थिस्थत हुये। मौके पर रिरट याधिचकाकता5 सदिहत सर्भी प्रर्भादिवत पक्ष उपस्थिस्थत रहे। 3- मौ)ा बामनौली में रिरट याधिचकाकता5 श्री मोहनपाल सिंसह पुत्र ग)े सिंसह दिनवासी ग्राम का नाम )ोत चकबन्दी आकार पत्र-23 र्भाग-1 के चक संख्या-1341 पर संक्रमणीय 2 of 4 र्भूदिम(cid:14)र के रूप में अंदिकत है। अनुसार अभिर्भलेख गाटा संख्या -1090 रकबा- 0.0632 हे० चकबन्दी पृथक द)5 है। गाटा संख्या० 1090 दिम० रकबा-0.6956 हे० का दिवदिनमय अनुपात सहायक चकबन्दी अधि(cid:14)कारी स्तर से 100 पैसे दिन(cid:14)ा5रिरत है, जि)समें चक संख्या -1213, 1314, 693, 1588, 1964, 50, 49, 2029, 1441,1348,183,830,2229,1585,795,2052,413 व,735,1341,291,7 1,1711,1377,757,362,1373,614, चकमाग5 प्रदिदष्ट है। याधिचकाकता5 के चक संख्या-1341 में गाटा संख्या-1090 रकबा-0.0420 हे० प्रस्तादिवत है। 4- गाटा संख्या-1090 का अधि(cid:14)कतर र्भाग चारदीवारी से धिPरा है एवं ग्राम की आबादी से दिमला है तथा आबादी के रूप में प्रयोग दिकया )ा रहा है। अधि(cid:14)कांश चकदारों द्वारा अपने-अपने चक में प्रदिदष्ट गाटा संख्या -1090 के रकबा का चारदीवारी का दिनमा5ण कर लिलया गया है। इस गाटे के उत्तर-पूव5 दिदशा में ग्राम में आने )ाने वाली पक्की सड़क बनी है। मौके पर गाटा संख्या-1090 में प्रदिदष्ट चकदारों/चकमाग5 की पैमाईश की गयी। गाटा संख्या-1090 में खाली र्भूदिम पर याधिचकाकता5 श्री मोहनपाल को उनके चक में प्रदिदष्ट गाटा संख्या-1090 रकबा-0.0420 हे० की दिनशानदेही कर कब्)ा लेने हेतु कहा गया, जि)सपर दिकसी र्भी प्रर्भादिवत पक्षकार द्वारा कोई दिवरो(cid:14) नही दिकया गया, अदिपतु याधिचकाकता5 द्वारा स्वयं ही कब्)ा लेने से इंकार कर दिदया गया। याधिचकाकता5 गाटा संख्या-1090 के उत्तर-पधिRम में स्थिस्थत सड़क के दिकनारे र्भूदिम चाहता है, )बदिक उक्त स्थान पर चकदारों द्वारा अपने अंश की र्भूदिम पर पूव5 से ही लगर्भग 06 फीट ऊं ची दीवार का दिनमा5ण कर लिलया गया है। याधिचकाकता5 इस दिनमा5ण को हटवाकर अपना कब्)ा प्राप्त करना चाहता है। याधिचकाकता5 द्वारा ऐसा कोई साक्ष्य उपलब्(cid:14) नहीं कराया गया दिक जि)ससे स्पष्ट हो सके दिक उनका उत्तर -पधिRम दिदशा में चक प्रदिदष्ट दिकया गया हो, जि)स स्थान पर वह कब्)े की मांग कर रहा है। पैमाईश पूण5कर संबंधि(cid:14)त चकदारों को कब्)ा परिरवत5न दिकये )ाने हेतु दिनदEश दिदये गये तथा मौके पर उपस्थिस्थत पक्षों में से याधिचकाकता5 श्री मोहनपाल सिंसह पुत्र ग)े सिंसह दिनवासी ग्राम ने हस्ताक्षर करने से मना कर दिदया गया एवं अन्य उपस्थिस्थत पक्षों द्वारा पैमाईश/ कब्)ा परिरवत5न संबं(cid:14)ी/ स्थलीय आख्या पर सहमधित के हस्ताक्षर अंदिकत दिकये गये हैं। गाटा संख्या-1090 का न)री- नक्शा एवं स्थल की छायाप्रधित साथ में संलग्न है। अतः मा० उच्च न्यायालय द्वारा पारिरत आदेश दिदनांक - 11.03.2025 की उपरोक्तानुसार अनुपालन आख्या मा० उच्च न्यायालय इलाहाबाद के समक्ष दालिखल कराने हेतु सेवा में सादर प्रेदिषत है। संलग्नक-यथोपरिर। र्भवदीय, ह० अप०

5. no.1, who is claiming possession of Plot No. 1090 cannot sustain 3 of 4 this petition. A part of Plot No. 1090 was demarcated and its possession was sought to be given to the petitioner, but he declined as that land did not abut the road. If he is aggrieved by any order passed by the competent authority, it is for the petitioner to seek his remedy before the authorities under the Act, 1953 and not by way of writ petition in this Court.

6. As far as petitioner no. 2 is concerned, who had asked for demarcation of Plot No. 1537/2, it is admitted that he has been delivered possession which fact is also recorded in the order dated

11.3.2025. Therefore, there exists no cause for interference in this writ petition.
