The instant contempt application has been filed by the applicant alleging disobedience of the order dated 19.03.2025 passed by this Court in Matters under Article 227 No. 1479 of 2025.

Learned counsel for the applicant submits that as the application under Order 39 Rule 1 & 2 of C.P.C. read with Section 151 of C.P.C. was not being decided in the pending Suit No. 3177 of 2024 (Ram Pratap Vs. Shiv Shankar and Anr.), the applicant preferred a petition i.e. Matters under Article 227 No. 1479 of 2025, which was disposed of on 19.03.2025 with direction to learned Civil Judge (J.D.), Raebareli to decide the application preferably within six weeks from the date of production of certified copy of the order.

The order dated 19.03.2025 passed by this Court in Matters under Article 227 No. 1479 of 2025 is as under:- "1. Present petition has been filed for the following relief: "Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to direct the learned Civil Judge (Junior Division) Raebareli to expeditiously decide the application Under Order 39 Rule 1 & 2 C.P.C. read with Section 151 C.P.C. bearing paper No.C-6Ga in Original Suit No.3177 of 2024 (Ram Pratap Versus Shiv Shankar & Another) pending in the Court of Civil Judge (Junior Division) Raebareli since 19.12.2024, in accordance with law, within time stipulated by this Hon'ble Court. "

Considering the relief as prayed for, the present petition is disposed off directing the Court concerned to decide the injunction application filed in the aforesaid suit with all expedition, preferably within six weeks from the date of filing of a certified copy of this order, in accordance with law. "

Learned counsel for the applicant further submits that the aforesaid order has been served to the competent authority, but the stay application has not been decided till today.

List this case on 11.08.2025 within top ten cases.

In the meantime, Sri Ramendra Yadav, Advocate holding brief of Sri Gaurav Mehrotra, Special Counsel for the High Court shall week written instructions from the respondent that why the order of this Court has not been complied with till today.

Registry is directed to show the name of Sri Gaurav Mehrotra, Special Counsel for the High Court as the counsel for the respondent, whenever the case is next listed.
