It is submitted by learned counsel for the applicant that the land in question i.e. plot no.199, applicant has filed Civil suit No.482 of 2021 in which interim injunction has been granted by the civil court vide order dated 14.10.2021. It is submitted that the present FIR has been lodged in the year 2024 ignoring the fact that the matter involves is purely a civil dispute and instituting criminal proceedings is bad.

Prima facie, the matter requires consideration.

Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.

Issue notice to opposite party no.2 returnable at an early date.

The opposite parties may file counter affidavit within four weeks.

Rejoinder affidavit may be filed within one week thereafter.

List immediately after expiry of the aforesaid period.
