Sri Syed Mohd. Munis Jafari, Advocate has filed his Vakalatnama today in Court on behalf of the opposite party No.2. The same is taken on record. The issue pertaining to the disputed parcel of land is pending before the competent civil court. An interim injunction is operating in favour of the brothers of the applicant, who claim to the owners of the property. The ownership claim is made on the footing of a compromise dated 31.12.1976, which became the basis of the order of the consolidation officer dated 16.01.1977. The aforesaid order was carried in appeal by the first informant before the Settlement Officer of Consolidation and the said appeal was allowed. The order passed by the appellate authority was taken before the revising court and the revision is pending adjudication. The investigations were deficient, inasmuch the exculpatory evidences were ignored by the Investigation Officer, and the orders passed by the competent consolidation authorities have not been obtained. Till the next date of listing, the effect and operation of the impugned summoning order dated 20.06.2025l passed by the learned court of Chief Judicial Magistrate, Court No. 18, Barabanki, charge-sheet dated 04.10.2024 numbered as 592 of 2024 and further proceedings of Criminal Case No. 25871 of 2025 arising out of FIR No. 135 of 2024, under Sections 167, 419, 420, 467, 468 and 471 I.P.C., Police Station Kotwali, District Barabanki, shall remain stayed.
