1. Heard Sri Somdautta Singh, the learned counsel for the applicants as well as Sri Rajesh Kumar Singh, the learned A.G.A.-I for the State and perused the record.

2. The instant application has been filed seeking release of the applicants on bail in Case Crime No.0113 of 2025, under Sections 115(2), 351(3), 352, 109, 118(1) B.N.S, registered at Police Station Khargupur, District Gonda.

3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 10.06.2025 against the applicants and an unnamed woman, stating that because of some altercations, the accused persons had abused and beaten up the informant's brother.

4. The injury report mentions that a teeth of the injured person was broken. The other injuries caused in the incident were simple in nature.

5. In the affidavit filed in support of the bail application, it has been stated that the applicants are innocent, they have been falsely implicated in the present case and they have no criminal history.

6. The learned A.G.A.-I has opposed the bail application and he has submitted the allegations have been established during investigation and a charge sheet has been submitted on 07.08.2025. 2 BAIL No. 8642 of 2025

7. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the applicants have no previous criminal history and they are languishing in jail since

12.06.2025 whereas the investigation already stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicants on bail.

8. Accordingly, this bail application stands allowed.

9. Let the applicants- Rinku, Bablu and Shiva Kant be released on bail in aforementioned case on furnishing a personal bond and two sureties each like amount the satisfaction of Magistrate/Court concerned, subject to the following conditions: - (i) the applicants shall not tamper with the prosecution evidence; (ii) the applicants shall not pressurize the prosecution witnesses; (iii) the applicants shall appear on each and every date fixed by the trial court.
