Judgment
Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P. and perused the record.
The present bail application has been filed on behalf of the applicant in Case Crime No.33 of 2025, under Sections 115(2), 352, 351(2), 191(2), 191(3), 105 of B.N.S., Police Station Hargaon, District Sitapur, with the prayer to enlarge him on bail.
Learned counsel for the applicant submitted that the applicant is an innocent person and has been falsely implicated in the present case and he is in jail since 28.02.2025. He further submitted that in the alleged incident, eight persons received injuries from the side of the applicant and 5 persons from the other side and one person also died. He further submitted that applicant is having no criminal antecedent except the present case, the charge sheet has already been filed and there is no possibility of tampering of any evidence. In these circumstances, the applicant is entitled for bail. In case of being enlarged on bail, he will not misuse the liberty of bail.
Learned A.G.A. has vehemently opposed the prayer of the applicant for grant of bail but he does not dispute the fact that there was a cross-case and persons from both the side received injuries.
Considering the rival submissions of learned counsel for parties, material available on record, contents of the F.I.R., other relevant documents as well as totality of fact and circumstances, it is evident that there was a cross-case from against both the sides and in the alleged incident, eight persons from the side of applicant also received injuries, as such, I am of the view that the applicant is entitled to be released on bail.
