Heard Sri Tanubhav Pandey, learned counsel for the applicant and Ms. Ladli Pandey, learned A.G.A. for the State and perused the material on record. The present bail application has been filed on behalf of applicant Kundan Singh under Section 439 of the Code of Criminal Procedure, with a prayer to enlarge him on bail in Case Crime No. 941 of 2023 for offence punishable under Sections 420, 467, 468, 471 of the Indian Penal Code, registered at Police Station- Tundla District- Firozabad during pendency of the trial, after rejecting the bail application of the applicant by Sessions Judge, Firozabad vide order dated 29.11.2024. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. It is further submitted that the first information report dated 26.11.2023 has been lodged against the applicant and other five named persons alleging that the applicant and other co- accused persons after receiving Rs. 55,00,000/- for procuring employment to the first informant and facilitating to get petrol pump in favour of the first informant. As per allegation of the first information report, there is no allegations with regard to receiving any amount by the applicant for delivering any forged documents. All the allegations have been made against co-accused Depesh Chaudhary. It is further submitted that co-accused Amit Mutreja has granted bail by this Court in Crl. Misc. Bail Application Nos. 47025 of 2024, vide orders dated 3.1.2025, respectively. He has next argued that applicant has criminal history of one other cases.
