CRIMINAL REVISION No. - 7282 of 2025 Chhote Lal State of U.P & Anr. v. Revisionist(s)

Heard learned counsel for the Revisionist and learned AGA for State.

It has been submitted by learned counsel for the Revisionist that Revisionist has been summoned in a complaint case based on the unregistered sale dated 12.09.2003 by which Opposite Party No.2 wants to execute an agreement of sale by initiated the proceeding in criminal course.

A perusal of impugned order shows that there is allegation made against the Revisionist that there was an agreement to sale between the Revisionist and Opposite Party No.2 dated 12.09.2003 executed on Rs.10/- stamp paper but the Revisionist has sold out the land to some one else by which he has cheated to Opposite Party No.2. It is also mentioned in the impugned order that a suit for specific performance of the agreement is also pending in the Civil Court. It is also appearing from the impugned order that the agreement to sale is not a registered document, therefore, considering the facts and submissions, the matter requires consideration.

Notice has already been issued to Opposite Party No.2 but as per office report, service report has not been received.

Concerned CJM is directed to submit a report regarding the service of notice within two weeks.

Opposite parties may file counter affidavit within a period of two weeks. Rejoinder affidavit, if any, may be filed within a week thereafter.

In the interest of justice, the proceeding of the Case No.2906 of 2022, (State versus Chhotelal), under Section 420 IPC, Police Station Auraiya, District Auraiya is hereby stayed, till the next date of listing. January 30, 2026 I.A.Siddiqui (Divesh Chandra Samant,J.)
