Judgment
Heard learned counsel for the petitioner-applicant and learned Standing Counsel.
The order dated 22.05.2024 is sought to be reviewed by means of this review petition.
In the writ petition, the petitioner had challenged e-challans relying upon U. P. Criminal Law (Composition of Offences & Abatement of Trial) (Amendment) Act, 2023. On account of the said amendment Act, traffic challans issued for the period from 31.12.2016 to 31.12.2021 were required to be abated.
The petition was allowed in part and insofar as challans at serial no. 15, 16, 17, 22, 23, 27 and 31 enumerated in the writ petition were concerned, the writ petition was dismissed holding that the said challans were not covered by the Amendment Act, 2023.
The submission of learned counsel for the applicant is that the afore-noted challans at serial no. 15, 16, 17 and 23 although were issued after 31.12.2021, but pertained to incidents which took place prior to 31.12.2021. These challans would therefore also be covered by the Amendment Act. However, counsel for the petitioner admits that challans at serial no. 22, 27 and 31 are not covered by the Amendment Act, 2023.
Learned Standing Counsel has not been able to dispute the afore-noted submission made by learned counsel for the petitioner- applicant.
Operative part
Accordingly, the review application is allowed.
The order dated 22.05.2024 is reviewed and the petition is allowed also with regard to challans at serial no. 15, 16, 17 and 23 regarding which it had been dismissed vide order dated
22.05.2024.
As a result, the writ petition stands allowed excepting challans at serial no. 22, 27 and 31 regarding which the writ petition stands dismissed. Order Date :- 19.7.2024\Aditya Tripathi
