Heard Sri Dhrub Narayan Kharwar, learned counsel appearing on behalf of petitioner and learned AGA for State.

Present petition has been preferred with the following prayers:- "A) Issue order or direction to direct Special Chief Judicial Magistrate, Meerut to decide the Case no. 9693 of 2022 (Jamil Chauhan vs. Sampadak and others) under Sectin 500 IPC, Police Station- Lisadhi Gate, District- Meerut, pending in the court of Special Chief Judicial Magistrate, Meerut, within stipulated period which may be fixed by this Court. "

Specific case has been made out by learned counsel for petitioner that complaint case no. 1573 of 2019 (Jamil Chauhan alias Ballu vs. Editor Dainik Jagran and others) was instituted at the behest of the petitioner wherein specific orders have been passed on dated 05.02.2021 through which learned court of Additional Civil Judge (Senior Divisional)/Additional Chief Judicial Magistrate, Court no. 7, District Meerut directed the Investigating Officer to investigate the matter in pursuance to Section 202(1) of Cr.P.C. but till today no report has been submitted by concerned Investigating Officer and the matter is pending at the behest of non-filing of the investigation report as directed by learned concerned court.

Although prayer has been made for expedite disposal of the complaint case no. 1573 of 2019 which has now been numbered as 9693 of 2022 but the same cannot be acceded due to pendency of the Inquiry report which has been narrated vide order dated 05.02.2021 under Section 202(1)Cr.P.C.

Be that as it may, if there is no other legal impediment, learned court of Additional Chief Judicial Magistrate, Meerut/concerned court is hereby directed to proceed in accordance with law by way of receiving report from the concerned Investigating Officer in pursuance to Section 202(1) Cr.P.C. as expeditiously as possible preferably within shortest period of time by way of calling progress report from the concerned Investigating Officer within a period of two months from the date of production of certified copy of this order.
