Heard learned counsel for the petitioner and Sri B.N. Singh, learned counsel for the respondent No. 4.
Present petition has been filed with following prayer:- "(i). To direct the Civil Judge(S.D.), Hathras to decide the application dated 30.01.2024 under Order 09, Rule-13 of CPC in P.M. Case No. 28 of 2022 (Lav Gaur Vs. All General and Special and another) within stipulated period. "
Learned counsel for petitioners submitted that aforesaid application is pending since long, therefore, a direction may be issued to decide the same at the earliest.
In the facts and circumstances of the case, the present petition is disposed of with direction to Civil Judge (S.D.), Hathras to decide application dated 30.01.2024 under Order 09 Rule 13 CPC in accordance with law, maximum within a period of three months from the date of production of certified copy of this order after providing opportunity of hearing to all concerned and without granting any unnecessary adjournment to either of the parties.
