Heard learned counsel for the petitioner.
Present petition has been filed with following prayer:- "(i). Direct the Additional Civil Judge (J.D.)/Judicial Magistrate, Court No. 26, Deoria to decide the application 6C under Order 39 Rule 1, 2 read with Section 151 C.P.C. arising out of Suit No. 3139 of 2023 (Amarkant Vs. Jainul Ansari and others), pending before him within stipulated period. "
Learned counsel for petitioners submitted that 6C application is pending since long, therefore, a direction may be issued to decide the same at the earliest.
In the facts and circumstances of the case, the present petition is disposed of with direction to Additional Civil Judge (J.D.)/Judicial Magistrate, Court No. 26, Deoria to decide 6C application in accordance with law, maximum within a period of three months from the date of production of certified copy of this order after providing opportunity of hearing to all concerned and without granting any unnecessary adjournment to either of the parties.
