Shri Aman Thakur, learned counsel appearing on behalf of petitioner no.1, Graduate Engineering Students Welfare Association, in Writ-A No. 4442 of 2024, has stated that he appears only for petitioner no.1 and has no instructions on behalf of petitioner nos.2 to 8, who are private persons. Shri Gaurav Mehrotra, learned Senior Advocate, assisted by Shri Utsav Mishra, learned counsel for respondent no.1 has pointed out the order passed by this Court in Writ-A No.4443 of 2024, wherein the only direction issued 2 WRIA No. 4442 of 2024 by this Court was that any selection, if made, shall abide by further orders of this Court. It appears that Shubham Chandra Tripathi and others, who are petitioners in Writ-A No.4443 of 2024, approached the Hon'ble Supreme Court by filing Special Leave to Appeal (C) No.12843 of 2024 and the Hon'ble Supreme Court passed an order on 07.06.2024 directing that the petitioner, Shubham Chandra Tripathi and all other degree holders shall be allowed to participate in the selection, but such selection shall be subject to the final order in this writ petition. Thereafter, the matter was again taken up by the Hon'ble Supreme Court on 27.11.2024 and the order dated 07.06.2024 was modified to the extent that the Hon'ble Supreme Court observed that as the writ petition was ripe for hearing, it should be decided expeditiously and in the meantime, no appointment shall be made in pursuance of the selection already held. Both the aforesaid orders dated 07.06.2024 and 27.11.2024 have been placed before this Court by Shri Gaurav Mehrotra, learned Senior Advocate, who states that in pursuance of the orders passed by the Hon'ble Supreme Court, Shubham Chandra Tripathi and all other degree holders were allowed to participate in the selection. The selection was completed, but the select list was not announced. Since the select list was not announced, no appointments have been made. Shri Upendra Nath Mishra, learned Senior Advocate, assisted by Shri Abhay Pratap Singh, learned counsel for the respondent has pointed out that impleadment applications were moved in Writ-A Nos. 4442 of 2024 and 4443 of 2024 on behalf of Satyam Rai and 19 others including U.P. Federation of Diploma Engineers stating that they would be the persons ultimately affected if any order is passed in this writ petition and, therefore, they ought to be impleaded. Shri U. N. Mishra, learned Senior Advocate states that pursuant to the filing of such impleadment applications, the Court has already granted them the right to intervene in the matter during the course of hearing. Shri Shireesh Kumar, learned counsel for the respondents states that in Writ- A No.4442 of 2024 and Writ-A No.4443 of 2024, he has also moved an application for impleadment on behalf of Alok Kumar and two others, who are diploma holders and whose rights would be affected in case the writ petition is allowed in favour of the petitioner. 3 WRIA No. 4442 of 2024 Shri Aman Thakur, learned counsel appearing on behalf of petitioner no.1 in Writ-A No.4442 of 2024 states that he intends to file another amendment application. 22.09.2025 passed by this Court in Writ-A No.4442 of 2024, wherein the Court recorded the appearance of Shri Asit Chaturvedi, learned Senior Advocate, who stated that he had been engaged only one day earlier and had not gone through the two amendment applications already moved by the petitioner. He wished to examine the same and then decide which amendment application he intended to pursue. It has been submitted by learned counsel for the respondents that the arguments raised by Shri Aman Thakur, learned counsel for petitioner no.1, are substantially the same as those made earlier by Shri Asit Chaturvedi, learned Senior Advocate before this Court. Shri Asit Chaturvedi had been granted sufficient time and although almost three months have passed, no fresh amendment application has been filed. Now an oral prayer has been made by Shri Aman Thakur, learned counsel, seeking permission not to press the earlier amendment applications and to file a fresh amendment application. We find that two amendment applications have already been moved and now a third amendment application is proposed to be filed. An oral prayer has been made by learned counsel for the petitioners expressing his intention not to press the earlier two amendment applications. Already, the paper book of Writ-a No.4442 of 2024 runs into more than six hundred pages taking into account all affidavits filed. We therefore dismiss this writ petition with liberty to the petitioners to file a fresh petition with proper pleadings and appropriate prayers. Interim order, if any, stands discharged. In Writ-A No. 4443 of 2024, nobody has appeared on behalf of the petitioners. Shri Upendra Nath Mishra, learned Senior Advocate assisted by Shri Abhay Pratap Singh and Shri Shireesh Kumar, learned counsel for the intervenors are present. 4 WRIA No. 4442 of 2024 Shri Gaurav Mehrotra, learned Senior Advocate assisted by Shri Utsav Mishra, learned counsel for respondent no. 1 is also present.
