Application under Section 482 Cr. P.C. has been filed seeking quashing of charge sheet dated 08.12.2021, cognizance/summoning order dated 24.12.2021 as well as proceedings of Criminal Case No.6 of 2022 (State v. Azam and others) arising out of Crime No. 620 of 2021 under Sections 323, 324, 325, 308, 504, 506 I.P.C., P.S. Seohara, District Bijnor pending before court of Additional Sessions Judge/F.T.C. 2nd, Bijnor.

Learned counsel for applicant has drawn attention to order passed by this Court earlier dated 07.05.2024 in Application under Section 482 Cr. P.C. bearing no.4561 of 2024 in which it has been indicated that the parties have amicably settled their disputes with filing of compromise dated 18.12.2023, which was thereafter directed to be veritied.

Learned counsel has drawn attention to verification order dated 28.05.2024 passed by trial court verifying aforesaid compromise. Certified copy of this order has been brought on record as Annexure-7 to the Application.

Although notices have been dispensed with in respect of opposite party no.2 but certified copy of the order dated 28.05.2024 clearly indicates verification of the compromise.

In view of conditions indicated in judgment rendered by Hon'ble the Supreme Court in Gian Singh v. State of Punjab reported in 2012 (10) SCC 303, the compromise shall form part of this order and a result thereof, the proceedings of Criminal Case No.6 of 2022 (State v. Azam and others) arising out of Crime No. 620 of 2021 under Sections 323, 324, 325, 308, 504, 506 I.P.C., P.S. Seohara, District Bijnor pending before court of Additional Sessions Judge/F.T.C. 2nd, Bijnor stand quashed.
