No.2, wheres applicant nos.2 3, and 4 are his close relatives. 3. Applicants no.1 to 3. are being summoned under Sections 498- A, 323, 504, 506 of I.P.C. and ¾ of D.P.Act, whereas applicant no.4 has been summoned under Section 354-A of I.P.C. by impugned order dated 4.7.2023 under Section 204 Cr.P.C.

4. Learned counsel for the applicants by referring the complaint filed by complainant submitted that dates mentioned therein do not support contents of application. 5. Learned counsel for the applicants further submitted that allegations made against applicant no.4 of outraging modesty of complainant is alleged to have occurred on 9.5.2023 by the complainant in her statement recorded under Section 200 Cr.P.C., whereas in the complaint such alleged occurrence is being mentioned to have occurred on 3.9.2023 i.e. there is vital contradiction in the said statement. He further referred that so far as allegation of demand of dowry, assault and intimidation to provoke to commit breach of peace is concerned are omnibus and general in nature. Only statement made by the complainant is that applicants have demanded additional dowry. No date, month or year has been mentioned in the complaint. He further submitted that statement of witnesses recorded under Section 202 Cr.P.C. also are allegations which remains omnibus and general in nature. 6. In order to appreciate above submissions, I have carefully perused materials available on record and for reference, impugned order is reproduced hereinafter: " ददिनननांक 04.07.2023 पतनवलली पपेश हहयली। पतनवलली तलबली पर आदिपेश हपेततु दनयत हहै। पररवनददियन कपे , पतनवलली कन दवदनन अधधिवकन कको तलबली कपे दबन्दितु पर सतुनन जन चतुकन हहै पररशलीलन दकयन। पनधररयन ककी ओर सपे पररवनदि करननक इस आशय कन पस्ततुत दकयन गयन हहै दक पनधररयन ककी शनदिली ददिनननांक 03.05.2022 कको दहन्दिद रलीदत ररवनज कपे अनतुसनर दवपकली पशनन्त कतु मनर कपे सनर सम्पन्न हहयली रली। शनदिली मम पनधररयन कपे मनतन दपतन नपे गगृहस्रली कन समस्त सनमनन एवनां सलीनपे व चनचाँदिली कपे आभदषण तरन 5,51,000 रुपयपे नगदि ददियपे रपे। शनदिली कपे बनदि ददियपे हहयपे दिनन दिहपेज सपे पनधररयन कपे ससतुरनललीजन सनांततुष्ट नहहीं हहयली और अदतररक दिहपेज मम एक कनर व पनचाँच लनख रूपयपे करनपे लगपे परन्ततु मननांग पदरली न हकोनपे पर उसकपे सनर शनरलीररक व मननधसक उत्पलीड़न करनपे लगपे। ददिनननांक 28.08.2023 कको समय 8.30 बजपे शनम कको पनधररयन कपे ससतुरनललीजन उसकको मनयकपे छकोड़ गयपे पनधररयन कपे दपतन नपे समनज कपे लकोगगों व ररश्तपेदिनरगों ककी मदिदि सपे ददिनननांक 10.09.2023 कको एक सनमनधजक पनांचनयत करनयली धजसमपे पनधररयन कपे ससतुरनललीजन ममौजददि रपे तको उसकपे ससतुरनललीजन बकोलपे जब तक अदतररक दिहपेज ककी मननांग पदरली नहहीं हकोगली तब तक उसकको नहली रखपेगम पनधररयन कपे दवनतली करनपे पर उपरकोक लकोग गनलली गलमौज कर नांसको सपे मनरपलीट करनपे लगपे पनांचनयत मम ममौजददि कनललीचरन, रनजवतली, मनकोज लनत घद कतु मनर, पतनप धसनांह दवमलन दिपेवली आददि लकोगको नपे बचनयन तको उपरकोक लकोग जनन सपे मनरनपे ककी धिमककी दिपेतपे हहयपे भनग गयपे पनधररयननां घटनन ककी ररपकोटर दिजर करननपे रननपे गयली लपेदकन मम उसककी ररपकोटर रननपे मम दिजर नहली हहयली तत्पश्चनत पनधररयन नपे घटनन ककी ररपकोटर ददिनननांक 12.09.2023 कको बजररयपे डनक वररष्ठ पतुधलस अधिलीकक दफिरकोजनबनदि कको भपेजली लपेदकन आज तक ककोई कनयरवनहली नहहीं हहयली। उक पनररनन पत कपे पकनश मम पररवनददियन नपे स्वयनां कन करन अन्तगरत धिनरन - 200 दिनां०प०सनां० एवनां सनकली पली०डब्लद० -2 मनकोज कतु मनर कन करन अन्तगरत धिनरन - 202 दिनां०प०सनां० न्यनयनलय मम अनांदकत करनयन गयन। पतनवलली कपे अवलकोकन सपे दवददित हकोतन हहै दक दवपकलीगण दनरन पररवनददियन कपे सनर अदतररक दिहपेज ककी मनचाँग कको लपेकर उसकन शनरलीररक व मनदनसक उत्पलीड़न करनपे एवनां मनरपलीट , गनलली गलमौज दकयपे जननपे एवनां जननसपे मनरनपे ककी धिमककी दिपेनपे तरन दवपकली रनजकमल उफिर शलीटद कपे दनरन पररवनददिनली कपे सनर जबरदिस्तली अश्ललील हरकत कर शलीलभनांग करनपे कपे आशय सपे उसपे दनवरस्व करनपे कन अपरनधि परम दृष्टयन पररलदकत हकोतन हहै। धजसककी पतुदष्ट पररवनददियन दनरन बयनन अन्तगरत धिनरन-200 दिनां०प०सनां० व पली० डब्ल्यद०-1 व पली०डब्ल्यद०-2 दनरन घटनन कन समररन दकयन गयन हहै। उपरकोक वदणरत तथ्यगों कपे आधिनर पर परम दृष्टयन अपरनधि कनररत दकयन जननन पररलदकत हकोतन हहै। इस पकनर पतनवलली पर उपलब्धि सनक्ष्यगों कपे पकनश मम अदभयतुकगण पशननांत कतु मनर , सतुरपेश कतु मनर शलीमतली - 498A, 323, 504, 506 जनन दिपेवली एवनां रनजकमल उफिर शलीटद कको धिनरन भन०दिनां०सनां० एवनां 3/4 दिहपेज पदतषपेधि अधधिदनयम तरन अदभयतुक रनजकमल उफिर शलीटद कको धिनरन 354 कपे भन०दिनां०स० कपे अन्तगरत दवचनरण हपेततु तलब करनपे कन पयनरप्त आधिनर हहै। आदिपेश अदभयतुकगण पशननांत कतु मनर, सतुरपेश कतु मनर, शलीमतली जनन दिपेवली एवनां रनजकमल उफिर शलीटद कपे दवरूद्ध धिनरन -498A, 323, 504, 506 भन०दिनां० सनां० एवनां धिनरन 3/4 दिहपेज पदतषपेधि अधधिदनयम तरन अदभयतुक रनजकमल उफिर शलीटद कपे दवरूद्ध धिनरन 354 कन भन०दि०सनां० कपे अन्तगरत अपरनधि हपेततु पसनांजनन धलयन जनतन हहै तरन अदभयतुकगण उपरकोक कको दवचनरण हपेततु जररयपे सम्मन तलब दकयन जनतन हहै। पररवनददियन सदचली गवनहनन दनयमननतुसनर दिनधखल करतपे हहए पहैरवली अन्दिर सप्तनह करम। पतनवलली वनस्तपे अदभयतुकगण ककी हनधजरली हपेततु ददिनननांक 05-08-2024 कको पपेश हको।" 7. There is a merit in the argument of learned counsel for applicants that no date, month or year has been mentioned in the complaint filed by the complainant as well as that there are omnibus and general allegations against applicant no.1 and his family members. 8. Learned Trial Court has not even mentioned statement of witnesses recorded under Section 202 Cr.P.C. even in brief, therefore, Court is of considered opinion that reasons assigned to summon the applicants under aforesaid sections are absent. 9. In aforesaid circumstances impugned order dated 4.7.2023 (probably it would be 4.7.2024) passed by learned Additional Chief Judicial Magistrate, Shikohabad, Firozabad in Complaint Case No.2376 of 2023 (Smt. Sapna Vs. Prashant Kumar & Ors) under Sections 498-A, 323, 504, 506 of I.P.C., Section 3/4 of D.P.Act and under Section 354-A of I.P.C., Police Station- Sirsaganj,District-Firozabad pending in the Court of learned Additional Chief Judicial Magistrate, Shikohabad, Firozabad is hereby set-aside. However, considering that this order is passed without issuing notice to O.P. No.2, therefore, this application is remanded back to learned Trial Court to pass a fresh order after hearing the complainant and taking note of above referred observations within a period of three months from today. 10.
