The applicant has approached this Court by way of present application under Section 482 Cr.P.C. to set-aside the impugned orders dated 20.03.2023 and 04.04.2024 passed by the Additional Chief Judicial Magistrate, Mahrauni, Lalitput in Complaint No. 661 of 2023 (Aleem Raza Vs. Shareef Ali and Others) under Sections 406, 504 and 506 I.P.C. Police Station Mahrauni, District and Lalitpur and also to quash the entire proceedings of Complaint No. 661 of 2023 (Aleem Raza Vs. Shareef Ali and Others) under Sections 406, 504 and 506 I.P.C. Police Station Mahrauni, District Lalitpur pending the Court of learned Additional Chief Judicial Magistrate, Mahrauni, Lalitpur. 3. The impugned order was framed under Section 204 Cr.P.C. and for reference the same is reproduced hereinafter:- "20.03.2023 पतत्रावलली वत्रास्तते आदतेश ननियत हहै। पररिवत्राद पत परि पररिवत्रादली कते नवदत्रानि अधधिवकत्रा कको तलबली परि पपूवर ननियत नतधथि परि ससुनित्रा जत्रा चसुकत्रा हहै। पररिवत्राद कत्रा ससंनक्षिप्त मते कथिनि इस प्रकत्रारि हहै नक पररिवत्रादली कते भत्राई ककी शत्रादली जत्राललौनि मम हहयली थिली। ररिश्ततेदत्रारिली कत्रा घरि मम आनित्रा जत्रानित्रा थित्रा नक आज सते करिलीब चत्रारि मत्राह पहलते शरिलीफ अलली , अफरिकोज अलली. परिवतेज, शलीमतली शहनित्राज, कलपू व शलीमतली सनको व धसकन्दरि एक जलीप मम सवत्रारि हकोकरि आयते औरि पररिवत्रादली सते समकोगरि मम नमलते तथित्रा कहनिते लगते नक हम लकोग एक शत्रादली मम जत्रा रिहते हहै जतेवरि भपूल गयते हहै औरि अपनिली पत्निली कते जतेवरि बतलौरि अमत्रानित दते दको शत्रादली कते बत्राद वत्रानपस करि दपू संगत्रा। महैनिते बत्राततों मम आकरि अपनिली पत्निली कते सकोनिते कते जतेवरित्रात नवश्वत्रास मम आकरि दते दली। कई बत्रारि मत्रासंगते परि उक लकोगको निते निहहीं नदयत्रा औरि कहनिते लगते नक जको नदखत्रायते सको करि लको औरि ज्यत्रादत्रा करिकोगते तको जको नदखत्रायते सको करि लको औरि ज्यत्रादत्रा करिकोगते तको जत्रानि सते मत्रारि दमगते। सम्पपूरर जतेवरित्रात पररिवत्रादली ककी पत्निली कते मत्रायकते कत्रा हहै। नदनित्रासंक 26.02.2023 कको उक मसुललजमत्रानि समय करिलीब 11 बजते नदनि कको मसुझते एक जलीप सते जत्रातते हहयते पसुनिनः महरिलौनिली ककी निहरि कते पत्रास नमलते। पररिवत्रादली निते उनिसते कहत्रा नक जको हमत्रारिली अमत्रानित हको वको ललौटत्रा दको उक मसुललजमत्रानि गत्रालली गललौच करिनिते लगते औरि कहनिते लगते नक जको नदखत्रायते सको करि लको ममनिते जब जकोरि दतेकरि कहत्रा तको कहनिते लगते नक ककोई कत्रायरवत्राहली करिकोगते तको जत्रानि सते मत्रारि दमगते। उक घटनित्रा कको मनिलीष, कसु लभपूषर, दलीनिदयत्राल निते दतेखली।" बयत्रानि 200 जत्रा०फलौ० कते अन्तगरत स्वयसं कको तथित्रा गवत्राहत्रानि अन्तगरत धित्रारित्रा 202 जत्रा० फकी० पली०डब्लपू- कसु लभपूषर झत्राझाँ व पली०डब्लपू-2 मनिलीष कसु मत्रारि कते रूप मम परिलीनक्षित करित्रायत्रा गयत्रा हहै। पररिवत्रादली निते अपनिते बयत्रानि अन्तगरतत् धित्रारित्रा 200 जत्रा०फलौ० मम पररिवत्राद पत कथित्रानिक कत्रा समथिरनि नकयत्रा तथित्रा सत्राक्षिलीगर दत्रारित्रा पररिवत्रादली कते कथित्रानिक कत्रा समथिरनि नकयत्रा गयत्रा हहै। मत्रानिनिलीय सवर्वोच्च न्यत्रायत्रालय दत्रारित्रा भपूषर कसु मत्रारि बनित्राम नदलली रित्राज्य आनद 2012 (1) जते०सली०आरि०सली० Pg-829 मम यह नवधधिक धसदत्रासंत प्रनतपत्रानदत नकयत्रा गयत्रा हहै नक "समननिरग आदतेश पत्राररित करितते समय मधजस्टट तेट कको यह दतेखनित्रा हकोतत्रा हहै नक अनभयसुकगर कते नवरूद कत्रायरवत्राहली करिनिते कते पयत्रारप्त आधित्रारि हहै अथिवत्रा निहली हहै तथित्रा इस नबन्दसु परि नवचत्रारि निहली करिनित्रा हकोतत्रा हहै नक अनभयसुक कको दकोषधसद नकयत्रा जत्रा सकतत्रा हहै यत्रा निहली तथित्रा मधजस्टट तेट कते धलयते आवश्यक निहली हहै नक वह समननिरग आदतेश पत्रास करितते समय नवस्ततृत आदतेश पत्राररित करिम।" पररिवत्रादली तथित्रा उसकते सत्राक्षिलीगरको कते बयत्रानिको कते आधित्रारि परि प्रथिम दृष्टयत्रा नवपक्षिलीगर कते नवरुद धित्रारित्रा 406, 504, 506 भत्रा०दसं०ससं० कत्रा मत्रामलत्रा बनितत्रा हहै। इस प्रकत्रारि मत्रामलते कते तथ्यको कको दृनष्टगत रिखतते हहयते पतत्रावलली मम उपलब्धि सत्राक्ष्यको कते आधित्रारि परि नवपक्षिलीगर कते नवरुद प्रथिम दृष्टयत्रा धित्रारित्रा 406, 504, 506 भत्रा०दसं०ससं० कत्रा दण्डनिलीय अपरित्राधि गनठित हकोतत्रा हहै। अतएव अनभयसुकगर नवचत्रारिर हतेतसु आहहत नकयते जत्रानिते यकोग्य हम। आदतेश अनभयसुकगर शरिलीफ अलली, अफरिकोज अलली, परिवतेज, शलीमतली शहनित्राज, कलपू, शलीमतली सनको व धसकन्दरि कको धित्रारित्रा 406, 504, 506 भत्रा०दसं०ससं० कते अपरित्राधि मम नवचत्रारिर हतेतसु जररियते सम्मनि आहहत नकयत्रा जत्रातत्रा हहै। पररिवत्रादली दत्रारित्रा पहैरिवली अन्दरि दस नदवस ककी जत्रावते। पतत्रावलली वत्रास्तते हत्राधजरिली मसुललजम नदनित्रासंक 10-04-2023 कको पतेश हको।" 4. I find merit in the arguments of learned counsel for the applicants that the contents of Section 200 and 202 Cr.P.C. has not been reflected even in brief in the above referred order, therefore,
Decision
the court takes note that the operative part of the impugned order is in teeth of the judgement passed by the Supreme Court in case of Lalankumar Singh and others Vs. State of Maharashtra, (2022) SCC OnLine SC 1383 the relevant part thereof is mentioned hereinafter: "38. The order of issuance of process is not an empty formality. The Magistrate is required to apply his mind as to whether sufficient ground for proceeding exists in the case or not. The formation of such an opinion is required to be stated in the order itself. The order is liable to be set aside if no reasons are given therein while coming to the conclusion that there is a prima facie case against the accused. No doubt, that the order need not contain detailed reasons. A reference in this respect could be made to the judgment of this Court in the case of Sunil Bharti Mittal v. Central Bureau of Investigation, (2015) 4 SCC 609 which reads thus: "51. On the other hand, Section 204 of the Code deals with the issue of process, if in the opinion of the Magistrate taking cognizance of an offence, there is sufficient ground for proceeding. This section relates to commencement of a criminal proceeding. If the Magistrate taking cognizance of a case (it may be the Magistrate receiving the complaint or to whom it has been transferred under Section 192), upon a consideration of the materials before him (i.e. the complaint, examination of the complainant and his witnesses, if present, or report of inquiry, if any), thinks that there is a prima facie case for proceeding in respect of an offence, he shall issue process against the accused. 52. A wide discretion has been given as to grant or refusal of process and it must be judicially exercised. A person ought not to be dragged into court merely because a complaint has been filed. If a prima facie case has been made out, the Magistrate ought to issue process and it cannot be refused merely because he thinks that it is unlikely to result in a conviction. 53. However, the words "sufficient ground for proceeding" appearing in Section 204 are of immense importance. It is these words which amply suggest that an opinion is to be formed only after due application of mind that there is sufficient basis for proceeding against the said accused and formation of such an opinion is to be stated in the order itself. The order is liable to be set aside if no reason is given therein while coming to the conclusion that there is prima facie case against the accused, though the order need not contain detailed reasons. A fortiori, the order would be bad in law if the reason given turns out to be ex facie incorrect." 5. From perusal of material available on record, it appears that there was no referejce of contents of statements recorded under Sections 200 and 202 Cr.P.C. and how offences are prima facie made out. 6. In the aforesaid circumstances, this Court invokes inherent power and impugned summoning order passed in above referred case is hereby quashed, however, considering that aforesaid order is passed without making any notice to opposite party No.2, therefore, matter is remitted back to trial Court to pass fresh order, considering the above dictum of Supreme Court. 7.
