I have also perused the statements of complainant and witnesses recorded under Section 200 and 202 Cr.P.C., which prima facie appears to be consistent that when complainant was objected to not to disturb the road to Abadi Area by JCB, applicants became violent and entered inside the house of complainant and committed alleged offence. There is also a case of outrage of modesty also but no one of applicants' side has been summoned for said offence. At this stage, this Court has to consider whether learned Trial Court has assigned requisite reasons that there are sufficient grounds to proceed against applicants or not. As referred above, learned Trial Court has assigned reasons, therefore, the order is passed in terms of provisions of Section 204 Cr.P.C. At this stage, the Court also takes note the judgment passed by Supreme Court in Lalankumar Singh and others Vs. State of Maharashtra, 2022 SCC OnLine SC 1383. So far as the argument in regard to rejection of application so filed for interim injunction and occurrence is concerned, it is also like a double edged sword since there is property dispute between parties, therefore, occurrence is possible. At this stage, this Court has not to scrutinize whether material available before the learned Trial Court was sufficient to convict the applicants or not. As referred above, since reasons have been assigned in impugned order that there are sufficient grounds to proceed against applicants as well as that the Court has not satisfied at this stage in regard to submission of a false case as well as for that applicants will have liberty at the stage of Section 244 Cr.P.C.,and thereafter also. Accordingly, I do not find any reason to interfere with impugned order, therefore, prayer made in this application is rejected and application is disposed of with direction that applicants shall appear before learned Trial Court within three weeks and subsequently if any bail application is filed by applicants, the same will be considered, expeditiously, in accordance with law, preferably on same day, subject to cause list of the Court concerned. Sri Abhishek Kumar Yadav, learned counsel for applicants submits that there is a property dispute between parties and an application was filed by complainant side for temporary injunction, however, no order was passed and soon thereafter, only in order to put pressure on applicants' side, a false criminal case was filed. In order to consider above submission, I have carefully perused the impugned order which is reproduced hereinafter :- " ददिनननांक 07.03.2024 पतनवलली वनस्तते आदितेशनरर पतेश हहयली। पररिवनददिनली कते दवदनन अधधिवकन कको ससुनन तरन पतनवलली कन सम्यक पररिशलीलन दकयन। सनांकतेप मम पररिवनददिनली नते पनररनन पत अन्तररत धिनरिन - 156(3) दिनां०प०सनां० पस्ततसु करि करन दकयन हहै दक घटनन ददिनननांक 04.05.2022 ई० कको समय करिलीब 8 बजते ससुबह कक हहै। पनधररनली अपनली सतेहन दिरिवनजते परि बहैठली रली। इतनते मम दवपकलीरण दवक्कक , दवशनल, कमलतेश व रिनमदमलन एकनएक उसकक आबनदिली कक जमलीन मते आनते जननते कन रिनस्तन बनांदि करिनते लरते औरि कहते दक यह रिनस्तन जते०सली०बली० सते रडन खकोदिवनकरि बन्दि करि दिमरते। तब पनधररनली नते कहन दक यह आम रिनस्तन हहै औरि इसली रिनस्तते सते हम लकोर व रननांव कते लकोर आतते जनतते हहै। इतनते परि दवपकलीरण ननरिनज हको रयते औरि भदली भदली रनधलयननां दितेनते लरते, मनन दकयन तको सभली लकोर एक रिनय हकोकरि लनठली डण्डन सते लहैस हकोकरि दवपकली कमलतेश कते ललकनरिनते परि पनधररनली कको दिदौडन धलयते वह डरिवश घऱ सते भनरली तको घरि मम घसुसकरि मनरिन पलीटन। मनरिपलीट कते दिदौरिनन दवपकली दवक्कक नते उसते पनधररनली कक सनडली खलीच लली औरि उसकन ब्लनउज फनड ददियते दचलननते परि उसते पटक ददियन औरि उपरि चढ रयते। रलते सते सकोनते कक धसकडली खखींच लली। शकोरि परि रवनहनन आयते घटनन दितेखली व बलीच बचनव दकयन। दवपकलीरण जनतते समय जनन सते मनरिनते कक धिमकक दितेतते हहयते चलते रयते। आवतेददिकन कते उपरिकोक पनररनन पत परि न्यनयनलय दनरिन ददिनननांक 25.07.2022 कको पनररित आदितेश सते उसकते आवतेदिन पनररनन पत अन्तररत धिनरिन 156(3) दिनां०प०सनां० कको पररिवनदि मम दिजर दकयन रयन। पररिवनददिनली कते दवदनन अधधिवकन कको तलबली कते दबन्दिसु परि ससुनन रयन। पतनवलली परि उपलब्धि पररिवनददिनली कते बयनन अन्तररत धिनरिन - 200 दिनां०प०सनां० व उसकते रवनहनन सली०डब्ललू०-1 दवमलन दितेवली व सली०डब्ललू०-2 धिमरन्द्र कसुमनरि कते बयनन अन्तररत धिनरिन-202 दि०प०सनां० एवनां पतनवलली परि उपलब्धि पपतत्रों कन अवलकोकन दकयन। पररिवनददिनली नते स्वयनां कको अन्तररत धिनरिन-200 दि०प०सनां० परिलीदकत करिनयन हहै। इस सनकली नते अपनते बयनन अन्तररत धिनरिन-200 दि०प०सनां० मम करन दकयन हहै दक घटनन ददिनननांक 05.05.2022 समय ससुबह आठ बजते कक हहै। मम अपनते दिरिवनजते बहैठली रली। दवक्कक, दवशनल, कमलतेश व रिनमदमलन मतेरिली आबनदिली कक जमलीन परि हमनरिते आनते जननते कते रिनस्तते मते जते०सली०बली० लरनकरि रडन खकोदि रिहते रते। मनन करिनते परि मसुझते उपरिकोक लकोर भदिदिली भदिदिली रनलली दिली। दिदौडन कते घरि कते अन्दिरि घसुस कते मनरिन पलीटन व कमलतेश व दवक्कक नते मतेरिते कपडते फनड ददियते। दचलननते परि मतेरिली बहन दवमलन, लडकक कसुससुम व पदत रिनममलूरित आयते बलीच बचनव दकयम दवपकलीरण नते इन लकोरको कको भली मनरिन पलीटन दवपकलीरण जनतते हहयते जनन सते मनरि डनलनते कक धिमकक ददियते। रननते परि सलूचनन दिली ककोई ससुनवनई नहली हहयली। कपनन सनहब कको भली पनररनन पत ददियन रन। पररिवनददिनली कते बयनन अन्तररत धिनरिन-200 दि०प०सनां० कन समररन रवनहनन सली०डब्ललू०-1 दवमलन दितेवली व सली०डब्ललू0-2 धिमरन्द्र कसुमनरि नते भली अपनते बयनन अन्तररत धिनरिन -202 दि०प०सनां० मम दकयन हहै। अततः पतनवलली परि इस स्तरि परि उपलब्धि सनक्ष्य कते आधिनरि परि दवपकलीरण दवशनल, दवक्कक, कमलतेश, रिनमदमलन कते दवरूद्ध परम दृष्टयन अन्तररत धिनरिन- 323, 451, 504, 506 आई०पली०सली० कन अपरिनधि रदठत हकोनन पतलीत हकोतन हहै। ऐसते मम दवपकली/अदभयसुक उक धिनरिनओ मम तलब दकयते जननते यकोग्य हहै। आदितेश अदभयसुकरण दवशनल, दवक्कक, कमलतेश, रिनमदमलन अन्तररत धिनरिन-323, 451, 504, 506 आई०पली०सली० कते अपरिनधि मम तलब दकयन जनतन हहै। दवपकलीरण उपरिकोक कको ददिनननांक 03.05.2024 कते धलयते समन जनरिली हको। पररिवनददिनली आवश्यक पहैरिवली अन्दिरि सपनह करिते।"
