1. It is informed that Sri Satyendra Singh, learned counsel for applicants is in personal difficulty, still considering that this application was filed on 05.05.2024 and despite listed earlier on various dates, it was not taken up for hearing due to heavy board and when matter is now taken today i.e. after about four months, taking note that applicants have sought relief under inherent power of this Court, therefore, this Court has requested Ms. Farha Naz, Advocate (AOR No. A/F0759/2022) to assist the Court as Amicus Curiae. She has read out contents impugned order passed on 15.02.2023 under Section 204 Cr.P.C. For reference, impugned order is reproduced hereinafter :- " ददिनननांक - 15-02-2023 पतनवलली पपेश हहई। पररिवनदिली कपे अधधिवकन ककी बहस कको पपूवर दतिधथि मम ससुनन जन चसुकन हहै। वनस्तिपे आदिपेश दनयति हहै। पररिवनदिली कन सनांकपेप मपे कथिन हहै दक उसकपे व उसकपे पररिवनरि कपे सनथि ददिनननांक . 02.05.2014 कको उसकपे घरि मम घसुसकरि दवपकलीगण नपे जनन सपे मनरिनपे ककी नलीयति सपे मनरिपलीट ककी थिली धजससपे गनांभलीरि चकोटटों कपे कनरिण उसककी पत्नली ककी ममृत्यसु हको गयली थिली। धजसकपे सम्बन्धि मम एक मसुकदिमन दवचनरिनधिलीन हहै। दवपकलीगण पररिवनदिली सपे रिनांधजश रिखतिपे हह। अतितः ददिनननांक 19.10.2014 कको पनथिर्थी अपनपे गननांव खपेडन ममौहम्मदिनबनदि सपे अपनपे पसुत कपे पनस फरिलीदिनबनदि कपे धलए चलन। पनथिर्थी बस मम बहैठकरि फपेस -2 बस स्टहैण्ड परि उतिरिकरि बस कन इन्तिजनरि करि रिहन थिन। तिभली पनथिर्थी कपे पनस दिको लकोग औरि खडपे थिपे औरि एक दबनन नम्बरि ककी मनरुदति वहैन आयली औरि मनरूदति वहैन कपे डडनईवरि नपे उसपे फरिलीदिनबनदि लपे जननपे कपे धलए बकोलन तिको वह वहैन मम बहैठ गयन औरि थिकोडन आगपे चलकरि एनईपलीजपेड ननलपे वनलली रिकोड परि वहैन कपे डनईवरि नपे गनडली रिकोककी, तिभली पलीछपे सपे एक गनडली आयली धजसमम सपे ससुनलील , दकशन व दिननवलीरि, दिको अजनति व्यदकयटों कपे सनथि नलीचपे उतिरिपे औरि पररिवनदिली कको दिबकोच धलयन औरि गनलली गलमौच करितिपे हहए बकोलपे दक तिसुझपे बहहति समझनयन तिपूनपे मसुकदिमन वनपस नहहीं धलयन। अतितः मनरिनपे ककी धिमककी दिली औरि पनथिर्थी कपे गदिरन मम फननांसली दिपेकरि गलपे मम रिस्सन खहींचकरि अधिमरिली हनलति मम फलनई ओवरि कपे पनस गनडली कपे नलीचपे फमक ददियन औरि फरिनरि हको गयपे। उपरिकोक पकरिण मम न्यनयनलय कपे आदिपेश सपे मसुकदिमन अपरिनधि सनां० 73/2015, दिजर दकयन गयन थिन धजस परि अनांदतिम आख्यन पपेदषिति हकोनपे कपे उपरिनन्ति न्यनयनलय दनरिन पररिवनदिली ककी पप्रॉटपेस्ट कको पररिवनदि कपे रूप मम दिजर दकयन गयन। धजसकपे उपरिननांति पररिवनदिली कन दिनदयत्व थिन दक वह अपनपे पक मम सनक्ष्य न्यनयनलय मम दिनधखल करिकपे अपनन कपेस सनदबति करिपे। पररिवनदिली नपे अपनपे ब्यनन अनांतिगरति धिरिन 200 सली.आरि.पली.सली मम ददिनननांक 19.10.2014 कपे सम्बन्धि मम यह कहन दक वह मनरूदति वहैन मम बहैठकरि एक्सपपेसवपे जननपे वनलपे रिनस्तिपे ककी ओरि चलन तिभली एनईपलीजपेड परि आगपे चलकरि डडनईवरि नपे गनडली रिकोककी तिभली पलीछपे सपे एक गनडली आयली धजसमम सपे चनरि लकोग दनकलपे औरि गनलली गलमौच करितिपे हहए पनथिर्थी कको गनडली सपे खहींच धलयन औरि धिमककी दिली दक उसपे भली उसककी पत्नली कपे पनस पहहनांचन दिमगपे एवनां पररिवनदिली कपे गलपे मम फनांदिन डनलकरि मनरिपलीट करिनपे लगपे धजससपे वह बपेहकोश हको गयन औरि उसपे फ्लनई ओवरि कपे पनस उतिनरिकरि चलपे गयपे। समस्ति पतनवलली कन अवलकोकन दकयन गयन। पररिवनदिली दनरिन दवपकलीगण दनरिन उसकपे गलपे मम रिस्सली कन फनांदिन डनलकरि जनन सपे मनरिनपे ककी नलीयति सपे हमलन करिनपे कपे आरिकोप लगनए हहै। इस सम्बन्धि मम धिनरिन 202 सली.आरि.पली.सली कपे तिहति सनकली कमृष्णन व दवनकोदि कपे ब्यनन अदकति दकयन हहै जको दक घटननस्थिल परि ममौजपूदि नहहीं थिपे। इसकपे अदतिररिक पनथिर्थी नपे यह स्पषलीकरिण नहहीं ददियन हहै दक उसनपे अदवलम्ब अपनली डप्रॉक्टरिली क्यटों नहहीं करिनयली एवनां ककोई भली मपेदडकल आख्यन पतनवलली मम सनांलग्न नहहीं हहै। इसकपे अदतिररिक ममौकपे परि ममौजपूदि डडनईवरि एवनां दकसली भली स्वतिनांत गवनहटों कको पपेश नहहीं दकयन हहै धजन्हकोनपे उपरिकोक घटनन कको पत्यक रूप सपे दिपेखन हह। अतितः समस्ति तिथ्यटों कको दृदषगति रिखतिपे हहए धिनरिन 307 आई.पली.सली. कन अपरिनधि दवपकलीगण कपे दवरूद्ध नहहीं सनदबति हकोतिन हहै। इसकपे अदतिररिक गनलली गलमौच व धिमककी दिपेनपे कपे आरिकोप हहै। अतितः दवपकलीगण ससुनलील, दकशन व दिननवलीरि कको धिनरिन 323, 504, 506 आई.पली.सली मम तिलब दकए जननपे कपे आधिनरि पयनरप्त हहै। आदिपेश दवपकलीगण ससुनलील, दकशन व दिननवलीरि कको धिनरिन 323,504,506 भन०दिनां०सनां० कपे अपरिनधि हपेतिसु दनरिन सम्मन तिलब दकयन जनतिन हहै। पररिवनदिली आवश्यक पहैरिवली दनयमननसुसनरि अनांदिरि सप्तनह करिपे। पतनवलली वनस्तिपे हनधजरिली ददिनननांक- 31.03.2023 कको पपेश हको।" 2. Ms. Farha Naz, Amicus Curiae refers that initially an FIR was lodged, thereafter investigation was conducted and a final report was filed. Thereafter a protest petition was considered as a complaint and impugned order was passed after statements recorded under Section 200 and 202 Cr.P.C. 3. Ms. Farha Naz, Amicus Curiae further submits that learned Magistrate has specifically held that no offence is made out under Section 307 I.P.C. mainly on ground that statements of witnesses recorded under Section 202 Cr.P.C. were not present at the place of occurrence. There was no explanation why a prompt medical examination was conducted as well as no relevant independent witness was examined. 4. Ms. Farha Naz, Amicus Curiae further submits that all the said grounds to return a finding that no offence is made out under Section 307 I.P.C. is equally applicable that no offence could be made out under Section 323, 504 and 506 I.P.C., however, learned Magistrate without giving any specific reason that there are sufficient grounds to proceed against applicants for offence under Sections 323, 504, 506 I.P.C. even after that no offence was made out under Section 307 I.P.C. on same facts. 5. The Court appreciate the above submissions and it appears that only for the sake of summon, learned Magistrate has summoned the applicants under Sections 323, 504, 506 I.P.C. without even giving any reason that there are sufficient grounds to proceed against applicants for such offence. Applicants are liable to get benefit of ground on which no case was made out under Section 307 I.P.C. 6. Accordingly, impugned order dated 15.02.2023 passed in Complaint Case No.1664 of 2017 (Fatte Singh Vs. Suneel and others) under Sections 323, 504, 506 I.P.C., Police Station- Phase-2, Gautam Buddh Nagar, pending before the Court of learned Additional Civil Judge, Junior Division-2, Gautam Buddh Nagar is set aside and since the order is passed without issuing notice to opposite party No.2, therefore, matter is remitted back to pass fresh order within three months, after hearing the complainant only. 7. Accordingly, application is disposed of with aforesaid observation. 8. The Court appreciate the quick and able assistance given by Ms. Farha Naz, Advocate (AOR No. A/F0759/2022) as Amicus Curiae, therefore, it is directed that she be paid Rs.2200/- by the High Court Legal Services Committee. 9.
