Decision
2. This Court has again encountered with an unreasoned impugned summoning order wherein contents of complaints were not mentioned and by referring only contents of statement recorded under Section 200 Cr.P.C. without even referring contents of statement recorded under Section 202 Cr.P.C. has summoned the applicants. For reference, the impugned order is quoted below -: "ददिनननांक -24.07.2023 पतनवलली आज तलबली आदिदेश हहँततु प्रस्ततुत हहयली। पररिवनदिली कदे दवदनन अधधिवकन ककी तलबली बहस पपूवर मम सतुनली जन चतुककी हहै। पररिवनदि पत मम पररिवनददिनली दनरिन धिनरिन 200 कदे अनांतररत कथन दकयन रयन हहै दक पररिवनददिनली कदे पतुत धिरिमदेन्द्र कन दववनह रिनमन दिदेवली कदे सनथ 2014 मम हहआ थन। दववनह कदे पश्चनत चचौथली परि रिनमनदिदेवली कदे पररिवनरि वनलदे उसकको लदे रयदे। कई बनरि रिनमनदिदेवली कको दवदिन करिननदे धिरिमदेन्द्र व अन्य लकोर रयदे दकनांततु उन्हहोंनदे दवदिन नहहीं दकयन। ददिनननांक 20.08.2018 कको अदभियतुकरण दबन्दिन प्रसनदि, मनकोज, आशनदिदेवली, रिनमनदिदेवली व उदिय धसनांह आयदे औरि सवदेरिदे 4 बजदे सभिली लकोर मदेरिदे घरि मम कमरिदे सदे बटतुवन , जदेवरि व 10,000/-रूपयदे नकदि लदेकरि चलदे रयदे। कनफकी लकोरहों नदे उन्हम सनमनन लदे जनतदे हहए दिदेखन। प्रनथर्थी नदे घटनन ककी ररिपकोटर दिजर करिननदे हदेततु थननन ककोतवनलली तहरिलीरि दिली दकनांततु ककोई कनयरवनहली नहहीं हहई। तब प्रनथर्थी नदे ददिनननांक 23.08.2018 कको शलीमनन पतुधलस अधिलीक्षक महकोदिय फतदेहपतुरि, कको जररियदे रिधजस्टरर रनक प्रनथरनन पत ददियन परिन्ततु उस परि भिली ककोई कनयरवनहली नहहीं हहई। तब प्रनथर्थी दववश हकोकरि मनननलीय न्यनयनलय ककी शरिण मम आयन हहै। पररिवनदिली दनरिन धिनरिन 200 दिण्र प्रदक्रियन सनांदहतन कदे अन्तररत स्वयनां कदे सनक्ष्य कको तथन धिनरिन 202 दिण्र प्रदक्रियन सनांदहतन कदे अन्तररत सनक्षलीरण PW1, PW2 कदे सनक्ष्य कको प्रस्ततुत दकयन रयन हहै। प्रपतहों कन सम्यक रूप सदे अवलकोकन दकयन। पतनवलली कदे अवलकोकन सदे दवददित हहै दक दवपक्षलीरण दनरिन प्रनथर्थी सदे मनरिपलीट, रनलली रलचौज कन कथन दकयन हहै। इसकदे अदतररिक पररिवनदि-पत, धिनरिन 200 एवनां 202 दिण्र प्रदक्रियन सनांदहतन कदे अन्तररत प्रस्ततुत सनक्ष्य कदे अवलकोकन सदे प्रथम दृष्टयन अदभियतुक दबन्दिन प्रसनदि , मनकोज, आशनदिदेवली, रिनमनदिदेवली व उदिय धसनांह दनरिन धिनरिन 356 भिन०दिनां०सनां० कन अपरिनधि कनररित दकयन जननन प्रकट हकोतन हहै। उपरिकोक आधिनरि परि दबन्दिन प्रसनदि, मनकोज, आशनदिदेवली, रिनमनदिदेवली व उदिय धसनांह दनरिन धिनरिन 356 भिन०दिनां० सनां० कदे अन्तररत बतचौरि अदभियतुकरण तलब दकए जननदे यकोग्य हहै। आदिदेश अदभियतुकरण दबन्दिन प्रसनदि, मनकोज, आशनदिदेवली, रिनमनदिदेवली व उदिय धसनांह दनरिन धिनरिन 356 भिन०दिनां०सनां० कदे अन्तररत बतचौरि अदभियतुद्ध रण तलब दकयन जनतन हहै। अदभियतुकरण जररिए सम्मन तलब हहों। पतनवलली वनस्तदे हनधजरिली ददिनननांक 26/09/2023 कको पदेश हको। 3. This Court has already taken a serious note of similar summoning order passed in Bangali Rathore and 3 others vs. State of U.P. and another, 2024:AHC:118989. 4. A judgment of Supreme Court in Lalankumar Singh and another vs. State of Maharashtra, 2022 SCC Online SC 1383 is relevant on this issue and its relevant paragraphs are mentioned below -: "38. The order of issuance of process is not an empty formality. The Magistrate is required to apply his mind as to whether sufficient ground for proceeding exists in the case or not. The formation of such an opinion is required to be stated in the order itself. The order is liable to be set aside if no reasons are given therein while coming to the conclusion that there is a prima facie case against the accused. No doubt, that the order need not contain detailed reasons. A reference in this respect could be made to the judgment of this Court in the case of Sunil Bharti Mittal v. Central Bureau of Investigation, (2015) 4 SCC 609 which reads thus: "51. On the other hand, Section 204 of the Code deals with the issue of process, if in the opinion of the Magistrate taking cognizance of an offence, there is sufficient ground for proceeding. This section relates to commencement of a criminal proceeding. If the Magistrate taking cognizance of a case (it may be the Magistrate receiving the complaint or to whom it has been transferred under Section 192), upon a consideration of the materials before him (i.e. the complaint, examination of the complainant and his witnesses, if present, or report of inquiry, if any), thinks that there is a prima facie case for proceeding in respect of an offence, he shall issue process against the accused. 52. A wide discretion has been given as to grant or refusal of process and it must be judicially exercised. A person ought not to be dragged into court merely because a complaint has been filed. If a prima facie case has been made out, the Magistrate ought to issue process and it cannot be refused merely because he thinks that it is unlikely to result in a conviction. 53. However, the words "sufficient ground for proceeding" appearing in Section 204 are of immense importance. It is these words which amply suggest that an opinion is to be formed only after due application of mind that there is sufficient basis for proceeding against the said accused and formation of such an opinion is to be stated in the order itself. The order is liable to be set aside if no reason is given therein while coming to the conclusion that there is prima facie case against the accused, though the order need not contain detailed reasons. A fortiori, the order would be bad in law if the reason given turns out to be ex facie incorrect." 5. In view of above discussion, I find that it is a fit case where inherent powers of this Court could be exercised. 6. Accordingly, impugned order dated 24.07.2023 passed in Complaint Case No.11320 of 2018 (Brijrani Vs. Binda Prasad and others) under Section 356 I.P.C., Police Station- Kotwali, District- Fatehpur, is hereby set aside and matter is remitted back to learned Trial Court to pass a fresh order within three months after hearing the complainant only. 7.
