There are litigations between parties with regard to some property as such their relations are not cordial. 3. Applicants have been summoned by means of impugned order dated 01.12.2023 passed under Section 204 Cr.P.C. by Additional Chief Metropolitan Magistrate, Court No. 4, Kanpur Nagar to face trial under Sections 324, 452, 506 IPC in Complaint Case No. 125680 of 2023 (Dhaniram vs. Ram Khelawan and others), Police Station Maharajpur, District Kanpur Nagar.

4. Learned counsel for applicants submits that criminal proceedings are arising out of a false case which is initiated only to put pressure on applicants. Alleged injuries are of simple in nature and could be self inflicted. 5. In order to appreciate the above submission, I have carefully perused the impugned order dated 01.12.2023 as well as injury report of injured and the same are reproduced hereinafter: Impugned summoning order "पपुककार पर पतकावलली पपेश। पररवकादली मय ववदकान अधधिवकका उपससस्थित। पररवकादली कपे ववदकान पधधिवकका कको तलबली बहस पर सपुनका। पररवकादली दकारका पकास्थिरनका पत पसतपुत करकपे ससंकपेप मम कस्थिन वकयका गयका हहै वक पकास्थिर्थी कका छकोटका भकाई रकामधखिलकावन उरर नन्हकक पकास्थिर्थी कपे सवकावमत्व वकालली कक वषि भकवम हड़पनपे कपे धलए ककारफी असर सपे पयकासरत चलका आ रहका हहै। रकामधखिलकावन उपरकोक पकास्थिर्थी कफी सहसवकावमत्व कफी कक वषि भकवम हड़पनपे कपे धलए ककारफी असर सपे पयकासरत ममौजका महकारकाजपपुर ककानपपुर कका दकान पत पकास्थिर्थी कपे भकाई दपेवली पसकाद सपे अनपुवचत तरलीकपे सपे करवका धलयका हहै। पकास्थिर्थी कको जकानककारली हकोनपे पर दलीवकान वकाद ससं 0-708 वषिर 2023 मकाननलीय न्यकायकालय धसववल जज सली०वडि० ककानपपुर नगर कपे यहकाहाँ पसतपुत वकयका तस्थिका न्यकायकालय सपे सम्मन जकारली हकोनपे पर रकामधखिलकावन पकास्थिर्थी सपे रसंधजश मकाननपे लगका हहै। रकामधखिलकावन उपरकोक पकास्थिर्थी कको परपेशकान करनपे कफी वनयत सपे गकाटका ससं 0-1390 एवसं 1393 कपे बलीच रकासतपे पर दलीवकार बनका दली हहै तस्थिका पकास्थिर्थी दकारका ववरकोधि करनपे पर मकार दपेनपे कफी धिमकफी दपेतका हहै। घटनका वदनकासंक 18.06.2023 समय करलीब 5 बजपे सकायसं कफी हहै। पकास्थिर्थी अपनपे घर कपे असंदर ररश्तपेदकार रकामकक ष्णका कपे दपेवलीपसकाद व लड़कपे मयसंक उरर लकालक तस्थिका वलीरपेश उरर वलीरू लकाठली डिसंडिका लपेकर गकालली गलमौज करतपे हहए पकास्थिर्थी कपे घर कपे असंदर घपुस आए तस्थिका सपुरपेश कपे ललककारनपे पर उक सभली लकोग पकास्थिर्थी कपे सकास्थि मकारपलीट करनपे लगपे तस्थिका रकामधखिलकावन नपे पकास्थिर्थी कफी हत्यका कपे इरकादपे सपे चकाकक सपे वकार कर वदयका। पकास्थिर्थी दकारका बचकाव वकए जकानपे पर उक चकाकक पकास्थिर्थी कपे बकाएहाँ हकास्थि मम लगका शकोर मचकानपे सपे चकाकक सपे वकार कर वदयका। पकास्थिर्थी दकारका बचकाव वकए जकानपे पर उक चकाकक पकास्थिर्थी कपे बकाएहाँ हकास्थि मम लगका शकोर मचकानपे पर पकास्थिर्थी कफी पत्नली भतलीजका रकाकपे श तस्थिका अन्य लकोगगों कपे आ जकानपे पर उक सभली लकोग पकास्थिर्थी हत्यका कर दपेनपे कफी धिमकफी दपेतपे हहए चलपे गए। उक मकारपलीट मम पकास्थिर्थी कपे शरलीर पर चकोटम आई हह तस्थिका पकास्थिर्थी आतसंवकत व भयभलीत हहै। पकास्थिर्थी नपे अपनपे शरलीर पर आई चकोटगों कका डिडॉक्टरली परलीकण उसरलका असपतकाल मम करवकायका हहै। पकास्थिर्थी नपे घटनका कपे ससंबसंधि मम धलधखित वशककायत जररए डिकाक उच्च अधधिककाररयगों कपे समक पसतपुत वकयका हहै। पकास्थिर्थी नपे पकास्थिरनकापत कपे समस्थिरन मम उच्चकाधधिककाररयगों कको पपेवषित पकास्थिरनका पत , पसंजलीकक त डिकाक रसलीद, मपेवडिकल कफी पवत, आधिकार ककाडिर कफी पवत , आवद पपत पतकावलली पर ससंलग्न वकयपे हह। पकास्थिर्थी नपे सवयसं कको बयकान धिकारका 200 दसं०प०ससं० कपे अन्तगरत्त परलीवकत करकायका तस्थिका बयकान असंतगरत धिकारका 202 दसं०प०ससं० बतमौर पली०डिब्लक-1 कपु मकारली ससंगलीतका तस्थिका पली०डिब्लक-2 कपे रूप मम रकाम कक ष्ण कको परलीवकत करकायका हहै धजन्हगोंनपे पररवकादली कपे पररवकाद कका पकणर समस्थिरन वकयका। सपुनका तस्थिका पतकावलली कका अवलकोकन वकयका। पकास्थिर्थी दकारका अपनपे बयकान असंतगरत धिकारका 200 दसं०प०ससं० मम कस्थिन वकयका गयका हहै वक पकास्थिर्थी वदनकासंक 18.06.2023 कको शकाम कपे करलीब 05 बजपे मम अपनपे ररश्तपेदकार कपे सकास्थि घर कपे असंदर बहैठपे स्थिपे। तभली ववपकलीगण घर मम घपुस आपे और ववपकली ससं० -01 जको ररश्तपे मम मपेरका छकोटका भकाई हहै। उसनपे कहका वक ' दलीवकानली वकाद ससं0-708/2023 कको उठका लको नहहीं तको जकान सपे मकार दपेगम। सपुरपेश नपे ललककारका धजसकपे बकाद ववपकली ससं०-1 नपे चकाकक सपे मपेरपे बकाए हकास्थि कपे बकाजक पर वकार वकयका धजससपे मपुझपे चकोटपे आई। ववपकलीगण नपे मपेरपे सकास्थि मकार-पलीट वकयका। घरवकालगों और गकासंववकालगों कपे बलीच-बचकाव सपे मह बच गयका। अततः मकामलपे कपे तथ्य एवसं पररससस्थिवतयगों कको दृवष्टिगत रखितपे हहए अवभयपुकगण रकामधखिलकावन उरर नन्हकका उरर सकाजन , श्रवण ककान्त, दपेवली पसकाद उरर छपु टई, मयसंक उरर लकालक, वलीरपेश उरर वलीरू एवसं सपुरपेश कपु मकार उरर पप्पक कको वकाद ववचकारण हपेतपु तलब वकयपे जकानपे कका पयकारप्त आधिकार न्यकायकोवचत पतलीत हकोतका हहै। आदपेश अवभयपुकगण रकामधखिलकावन उरर नन्हकका उरर सकाजन , श्रवण ककान्त, दपेवली पसकाद उरर छपु टई, मयक उरर लकालक, वलीरपेश उरर वलीरू एवसं सपुरपेश कपु मकार उरर पप्पक कको असंतगरत धिकारका-324,452,506 भका०दसं०ससं० कपे अन्तगरत न्यकायकालय मम ववचकारण हपेतपु जररयपे सम्मन तलब वकयका जकातका हहै। पररवकादली उवचत पहैरवली करम , सकचली गवकाहन दकाधखिल करम। पतकावलली वकासतपे हकाधजरली अवभयपुकगण वदनकासंक 20.01.2024 कको पपेश हको।" Injury report of injured “Details of Injuries:- 1. Contusion 6X0.5 cm on top of Lt Side forehead 2 cm above Lt eye brow margins irregular and swelled. 2. Abrasion 9X1 cm Rt Side Arm. 7 cm above Rt elbow joint margins irregular and reddish in colour. 3. IW 5X2 cm on lt side arm 12 cm above lt elbow joint margins irregular and sharp bleed present redish in colour muscle exposed. 4) Abrasion 12 cm 1 cm back of chest (Rt) 2 cm away from back of scapula margins irregular and redish in colour. 5) Scapula margins irregular and redish in colour. Opinion- All injuries simple in nature except injury no. (3) Duration of Injuries- Fresh Weapon/Object Used- Hard & blunt object except injury no. (3) caused by sharp object. Refer for any test or further specialist opinion on 18/06/2023 at 7.25 PM” 6. Complainant has disclosed his relationship with accused and that they have assaulted him. Trial Court also has considered the relationship of parties as well as that there are litigations between them and also takes note of nature of injuries and since one of the injury is grievous in nature, therefore, applicants have been summoned under Section 324 IPC also. 7. The argument with regard to false implication cannot be appreciated at this stage since Court cannot ignore injury report of injured, who was promptly examined. The fact that their relations are not cordial, makes the occurrence probable. Impugned order, as referred above, has assigned reasons that there are sufficient material to proceed against applicants. I, therefore, do not find any reason to invoke inherent jurisdiction of this Court. 8. At this stage, learned counsel for applicants submits that applicants are ready to appear before Trial Court and prayed that Trial Court may be directed to decide their bail applications in accordance with law, preferably on same day. 8. Learned A.G.A. appearing for State has no objection against the aforesaid prayer. 9. Accordingly the prayers made in this application are rejected. However, the

application is disposed of with observation that in case applicants appear within a period of two weeks from today and file their bail application, Trial Court concerned shall consider and decide the same in accordance with law, preferably on same day, subject to cause list of concerned Court and if facts of case falls within the parameters of a judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773, the same may also be taken note of.
