During the argument, a legal issue has cropped up that while passing an order under Section 204 Cr.P.C., learned Trial Court could rely upon the documents such as statement of witnesses recorded under Section 161 Cr.P.C. as well as statement of victim recorded under Section 164 Cr.P.C. to summon the applicants without much emphasizing the statements recorded before him i.e. under Sections 200 and 202 Cr.P.C. 3. It would be relevant to refer that complaint has initially lodged an FIR, wherein after investigation a final report was submitted. On which a protest petition was filed, which was considered to be a criminal complaint and accordingly learned Trial Court proceed further. 4. It is not under much dispute that the procedure for trial on basis of police report and a complaint case are different. In a case arising out of complaint, the Magistrate has to conduct inquiry himself and on basis of statement recorded on oath before him under Sections 200 and 202 Cr.P.C., an order could be passed under Section 203 or 204 Cr.P.C., as the case may be without taking reference of documents referred in final report. 5. In present case, while passing the final order, learned Trial Court has much taken note of statements recorded during investigation under Section 161 and 164 Cr.P.C. which is on face of it, is a legal infirmity. In this regard, few paragraphs of recent judgment passed by this Court in the case of Udairaj Singh @ Udaiveer And 5 Others Vs. State of U.P. and Another, 2024:AHC:124812 being relevant are quoted hereinafter :- "11. The argument of learned counsel for applicants is that the learned Magistrate could not peruse material placed alongwith the charge sheet and in present case the document is a medical report. Though, he may be legally correct in regard to statements recorded under Sections 161 Cr.P.C. or 164 Cr.P.C. after Protest Petition was considered as a complaint but the Magistrate, who is conducting an investigation himself under the procedure as provided under Cr.P.C. for complaint case is not so handicapped that even it could not look the material annexed alongwith charge sheet, specifically a document, which could fall within fore corner of a 'public document' as deprived under Section 74 of Indian Evidence Act. It is not under disputed that medical report was placed on record during investigation, therefore, a medical report collected during investigation is a public document and contents thereof are not much in dispute. Learned Magistrate has perused the said document only in order to verify statement of injured as well as statement of doctors recorded under Section 202 Cr.P.C., which was completely corroborated. Therefore, there was no legal error if the Magistrate has looked into the medical report annexed alongwith charge sheet, even while passing an order under Section 204 Cr.P.C. At one stage, learned Magistrate has referred that these documents were available on record (पतत्रावलल). " 6. Relevant part of impugned order is mentioned hereinafter :- " पररिवत्राददिनल दत्रारित्रा ममुख्य रूप ससे पररिवत्रादि कथत्रानक मम यह कथन दकयत्रा गयत्रा हहै। दक पत्राररिवत्राददिनल कसे पदति ककी ममृत्यमु हहो जत्रानसे कसे उपरित्रान्ति पररिवत्राददिनल कत्रा दिसेवरि दशिव प्रकत्राशि सससिंह कसे दत्रारित्रा पररिवत्राददिनल कसे सत्राथ उसककी इच्छत्रा कसे दवरूद्ध जबरिदिस्तिल ससिंबसिंध बनत्रायत्रा एवसिं दकसल कहो बतित्रानसे पररिवत्राददिनल व उसककी दिहोननों बचच्च्चियनों कहो जत्रान ससे मत्रारिनसे ककी धमककी ददियत्रा तिथत्रा पररिवत्राददिनल गसिंदिल गसिंदिल गत्रासलयत्रासिं दिसेतिसे हहए लगत्रातित्रारि पररिवत्राददिनल कत्रा शिहोषण करितित्रा रिहत्रा व पररिवत्राददिनल कई बत्रारि दशिव प्रकत्राशि सससिंह कसे ससिंसगर ससे गररवतिल हहोनसे कसे दिदौरित्रान दशिव प्रकत्राशि सससिंह दिवत्रा दिसेकरि पररिवत्राददिनल कत्रा एबत्राशिरन करित्रा ददियत्रा। पररिवत्रादि पत कसे कथत्रानक कत्रा समथरन पररिवत्राददिनल दत्रारित्रा अपनसे बयत्रान अन्तिगरति धत्रारित्रा - 200 दिसिं.प्र.ससिं. व सत्राकलगण पल.डब्लल.1 मदहमत्रा यत्रादिव व पल.डब्लल.2 उदिय नरित्रायन सससिंह यत्रादिव दत्रारित्रा दकयत्रा गयत्रा हहै। पररिवत्राददिनल दत्रारित्रा अपनसे बयत्रान अन्तिगरति धत्रारित्रा- 200 दिसिं.प्र.ससिं. मम ममुख्य रूप ससे कथन दकयत्रा गयत्रा हहै दक उसकसे पदति ककी ममृत्यमु 13 ससतिम्बरि 2003 कहो हहोनसे कसे उपरित्रान्ति ससे हल दवपकल दशिवप्रकत्राशि (दिसेवरि) दत्रारित्रा उसककी इच्छत्रा कसे दवरूद्द उसससे सम्बन्ध बनत्रातित्रा थत्रा, मनत्रा करिनसे परि उससे व उसककी पमुदतयनों कहो जत्रान ससे मत्रारिनसे ककी धमककी दिसेतित्रा थत्रा। पररिवत्राददिनल कसे गररवतिल हहो जत्रानसे कसे दिदौरित्रान जबरिदिस्तिल उसकहो दिवत्रा सखिलत्राकरि तिलन बत्रारि उसकत्रा गररपत्राति करिवत्रा ददियसे जत्रानसे कत्रा कथन दकयत्रा गयत्रा हहै , सजसकत्रा समथरन पररिवत्राददिनल दत्रारित्रा दिदौरित्रान दववसेच्चिनत्रा दववसेच्चिक कहो ददियसे गयसे बयत्रान अन्तिगरति धत्रारित्रा 161 दिसिं.प्र.ससिं. व न्यत्रायत्रालय मम मसजस्टटसेट कसे समक ददियसे गयसे बयत्रान अन्तिगरति धत्रारित्रा 164 दिसिं.प्र.ससिं. मम रल दकयत्रा गयत्रा हहै। पररिवत्राददिनल दत्रारित्रा बयत्रान अन्तिगरति धत्रारित्रा 161 दिसिं.प्र.ससिं. मम कथन दकयत्रा गयत्रा हहै दक उसकसे पदति ककी ममृत्यमु ददिनत्रासिंक 13.09.2003 कहो हहो जत्रानसे कसे परित्रान्ति उसकसे दिसेवरि दशिवप्रकत्राशि सससिंह कसे दत्रारित्रा जबरिदिस्तिल उसकसे सत्राथ शित्रारिलररिक ससिंबसिंध बनत्रातित्रा थत्रा उससे रद्दल-रद्दल गत्रासलयत्रासिं दिसेतित्रा थत्रा व उससे व उसककी दिहोनहो पमुदतयनों कहो जत्रान ससे मत्रारिनसे ककी 003रिल नजरि रिखितित्रा थत्रा एवसिं दशिवप्रकत्राशि उससे घरि मम अकसेलत्रा पत्रातित्रा थत्रा तिहो जबरिदिस्तिल उसकसे सत्राथ दमककी दिसेतित्रा थत्रा एवसिं दशिवप्रकत्राशि सससिंह कसे ससिंसगर ससे वह तिलन बत्रारि प्रसेगनसेन्ट हहयल थल सजसकत्रा शिसेवप्रकत्राशि सससिंह दत्रारित्रा तिलननों बत्रारि जबरिदिस्तिल दिवत्रा सखिलत्राकरि उसकत्रा गररपत्राति करित्रा ददियत्रा गयत्रा। सत्राथ वस्यत्राददिनल दत्रारित्रा बयत्रान अन्तिगरति धत्रारित्रा 164६.प्र.ससिं. मम कथन दकयत्रा गयत्रा हहै दक उसकसे पदति महै ममृत्यमु ददिनत्रासिंक 13.09.2003 कहो हहो जत्रानसे कसे उपरित्रान्ति उसकसे दिसेवरि दशिवप्रकत्राशि सससिंह दत्रारित्रा जबरिदिस्तिल उसकसे सत्राथ शित्रारिलररिक ससिंबसिंध बनत्रातित्रा थत्रा तिथत्रा उससे रद्दल-रद्दल गत्रासलयत्रासिं दिसेतित्रा थत्रा व उससे व उसककी दिहोनहो पमुदतयनों कहो जत्रान ससे मत्रारिनसे ककी धमककी दिसेतित्रा थत्रा एवसिं दशिव प्रकत्राशि एवसिं दशिवप्रकत्राशि सससिंह ससे ससिंससिंगर ससे वह तिलन बत्रारि प्रसेगनसेन्ट हहयल थल सजसकत्रा दशिवप्रकत्राशि सससिंह दत्रारित्रा तिलनहो बत्रारि जबरिदिस्तिल दिवत्रा सखिलत्राकरि उसकत्रा गररपत्राति करित्रा ददियत्रा गयत्रा। सत्राथ हल पररिवत्राददिनल दत्रारित्रा बयत्रान अन्तिगरति धत्रारित्रा 164 दिसिं.प्र.ससिं. मसे कथन दकयत्रा गयत्रा हहै दक उसकसे पदति ककी ममृत्यमु ददिनत्रासिंक 13.09.2003 कहो हहो जत्रानसे कसे उपरित्रान्ति उसकसे दिसेवरि दशिवप्रकत्राशि सससिंह दत्रारित्रा उस परि बमुरिल नजरि रिखितित्रा थत्रा एवसिं दशिवप्रकत्राशि उससे घरि मम अकसेलत्रा पत्रातित्रा थत्रा तिहो जबरिदिस्तिल उसकसे सत्राथ शित्रारिलररिक ससिंबसिंध बनत्रातित्रा थत्रा मनत्रा करिनसे परि उसककी बसेदटयनों कहो जत्रान ससे मत्रारिनसे ककी धमककी दिसेतित्रा थत्रा तिथत्रा दशिवप्रकत्राशि सससिंह अक्सरि उससे गसिंदिल -गसिंदिल गत्रासलयत्रासिं दिसेतित्रा थत्रा। दशिवप्रकत्राशि ससे तिलन च्चित्रारि गररवतिल हहयल परिन्तिमु यह उससे तिलनहो बत्रारि दिवत्रा सखिलत्रायत्रा सजसससे उसकत्रा गररपत्राति हहो गयत्रा। पररिवत्राददिनल दत्रारित्रा अपनसे बयत्रान अन्तिगरति धत्रारित्रा 200दिसिं.प्र.ससिं. व धत्रारित्रा-161 दिसिं.प्र.ससिं. व 164 दिसिं.प्र.ससिं. कसे बयत्रान मम गररपत्राति करित्रायसे जत्रानसे कत्रा कथन दकयत्रा गयत्रा हहै परिन्तिमु पररिवत्राददिनल दत्रारित्रा इस सम्बन्ध मम कहोई दच्चिदकत्सलय प्रपत दित्रासखिल नहहीं दकयत्रा गयत्रा हहै सजसससे धत्रारित्रा -313 रत्रा.दिसिं.ससिं. कत्रा अपरित्राध कत्राररिति दकयत्रा जत्रानत्रा प्रकट नहहीं हहोतित्रा हहै। उपरिहोक्त दवश्लसेषण, पररिवत्रादि पत कसे कथत्रानक एवसिं सत्राकलगण कसे बयत्रान तिथत्रा पतत्रावलल मम दित्रासखिल दिस्तित्रावसेजल सत्राक्ष्य व बयत्रान अन्तिगरति धत्रारित्रा 161 दिसिं.प्र.ससिं. तिथत्रा बयत्रान अन्तिगरति धत्रारित्रा 164 दिसिं.प्र.ससिं. कसे आधत्रारि परि दशिवप्रकत्राशि कहो प्रथम दृष्टयत्रा दवच्चित्रारिण हसेतिमु अन्तिगरति धत्रारित्रा-376 , 504, 506 रत्रा.दिसिं.ससिं. कसे तिहति तिलब दकयसे जत्रानसे यहोग्य हहै। आदिसेशि अदरयमुक्त दशिवप्रकत्राशि सससिंह कहो असिंतिगरति धत्रारित्रा 376. 504, 506 रत्रारितिलय दिण्ड ससिंदहतित्रा कसे तिहति प्रथम दृष्टयत्रा दवच्चित्रारिण हसेतिमु तिलब दकयत्रा जत्रातित्रा हहै। पररिवत्राददिनल आवश्यक पहैरिवल अदरलम्ब करिम। बत्रादि पहैरिवल गवत्राहत्रान सलच्चिल दित्रासखिल करिनसे परि अदरयमुक्त कहो जररिए सम्मन ददिनत्रासिंक 29.03.2024 कहो वत्रास्तिसे हत्राजरिल आहहति दकयत्रा जत्राए। पतत्रावलल उक्त दनयति दतिसथ कहो हत्राजरिल हसेतिमु पसेशि हहो।" 7. In the aforesaid circumstances, since by the learned Trial Court has taken much note of statement recorded under Sections 161 and 164 Cr.P.C. during investigation, while passing an order under Section 204 Cr.P.C., without much appreciating statements recorded under Sections 200 and 202 Cr.P.C., therefore, a legal infirmity has occurred. 8. Accordingly, impugned order dated 22.02.2024 passed in Complaint Case No. 33 of 2024 under Sections 376, 504 and 506 I.P.C., Police Station- Sarnath, District Varanasi is set aside and since this order is passed without hearing complainant, therefore, matter is remitted back to learned Trial Court to pass a fresh order in the light of procedure under Sections 200 and 202, 203 and 204 Cr.P.C. within three months after hearing the complainant. 9.
