Heard Shri Prabhakar Awasthi, learned counsel for the appellant-petitioner; Shri Fuzail Ahmad Ansari, learned Standing Counsel for State respondents and Shri Anurag Shukla, learned counsel for respondent no.6. 2. The instant intra court appeal is preferred against the judgment and order dated 01.07.2024 passed by learned Single Judge in Writ-A No.9048 of 2024 (C/M Kalka Prasad Ram Chandra Kala Kendra Girls Inter College v. State of U.P. & Ors.) as well as the order dated 20.05.2024 passed by respondent no.2, Director of Education (Secondary). 3. The aforesaid writ petition was filed by the Committee of Management assailing the validity of the order dated 20.5.2024 passed by the Director, Secondary Education, U.P, whereby the District Inspector of Schools has been directed to reinstate the respondent no.6-Smt. Mamta Kumari on the post of Officiating Principal of the College and the Regional Joint Director has been directed to initiate the proceeding under Section 16-D (3) (i) & (ii) of the Intermediate Education At, 1921. The said order was assailed on the ground that the Director is having no authority to pass such an order and the same is liable to be set aside only on this sole ground. Learned Single Judge has denied to interfere with the said order and dismissed the writ petition by order dated 1.7.2024. 4. The record in question reflects that earlier the Committee of Management had instituted Writ-A No.16044 of 2023 (C/M Kalka Prasad Ram Chandra, Kala Kendra Girls Inter College, Bareilly through its Manager v. State of U.P. & Ors.). The said writ petition was heard along with Writ-A No.16901 of 2023 (Smt. Mamta Kumari v. State of U.P. & Ors.). Learned Single Judge vide order dated 31.10.2023 had proceeded to dispose of both the matters with detailed observations as under:- "1. Heard Sri Rizwan Ahmad (Qureshi), learned counsel for the petitioner in the leading petition and the fourth respondent in the connected writ petition, Sri H.K. Shukla, learned Standing Counsel, who appears for Respondent Nos. 1 to 3 in the leading as well as in the connected writ petition and Sri Sankalp Narain, who appears for the fourth respondent in the leading writ petition and for the writ petitioner in the connected writ petition. 2. Since the writ petitions are inter-connected with each other with respect to the issues raised, thus with the consent of the parties, the writ petitions are being decided at the fresh stage. 3. A joint statement has been made by the learned counsels for the rival parties that they do not propose to file any response to the writ petitions, thus this Court is taking up the matters and hearing the same on board. 4. Incidentally, the leading writ petition is listed under the caption of fresh cases at Sl. No. 14 and the connected writ petition is listed at Sl. No.44, under the same caption, thus they are being consolidated together. 5. Principally, the issue, which is raised in the present writ petition originates from the resolution of the Committee of Management of the Institution in question dated 04.06.2023 placing one Smt. Mamta Kumari, who happens to be the Acting Principal of the Institution in question, who has been suspended by virtue of the order dated 05.06.2023. It has also been pointed out that the matter with respect to the approval of the suspension of Smt. Mamta Kumari was engaging attention before the District Inspector of Schools, Bareilly, who in turn proceeded to pass an order dated 23.06.2023 whereby the suspension of Smt. Mamta Kumari, Acting Principal of the Institution in question has been disapproved. 6. Questioning the order dated 23.06.2023, passed by the District Inspector of Schools, Bareilly, the leading writ petition has been filed. In so far as the connected petition is concerned the same has been filed by Smt. Mamta Kumari for a direction to ensure payment of salary to the writ petitioner and to make her admissible for the benefits, which she is liable to enjoy as an Officiating Principal. 7. Sri Rizwan Ahmad (Qureshi) submits that the order of the District Inspector of Schools, Bareilly dated 23.06.2023 disapproving the suspension of Smt. Mamta Kumari has been passed in violation of the principles of natural justice, thus, according to him, the order be set aside and the matter be remitted back. 8. Sri Sankalp Narain, who appears for Smt. Mamta Kumari, submits that might be the Committee of Management was not heard and put to notice before passing of the order dated 23.06.2023, but Smt. Mamta Kumari has not been paid salary and has not been made admissible to the benefits of the Officiating Principal. He thus submits that let the order be set aside, the matter be remitted back so as to accord fresh consideration to the matter after hearing the concerned parties. The submission of Sri Sankalp Narain has been adopted by Sri H.K. Shukla, learned Standing Counsel. 9. Since a statement has been made by the learned counsels for the rival parties that they do not propose to file any response to the writ petitions and the writ petitions are being decided in the following terms:- (a) The order dated 23.06.2023 is set aside; (b) The matter stands remitted back to the District Inspector of Schools, Bareilly; (c) Consequent to the remand, the District Inspector of Schools, Bareilly shall fix a date in the week commencing 20.11.2023 for the purpose of hearing the parties after giving due information to the Committee of Management and Smt. Mamta Kumari; (d) after exchange of the versions, submitted by them, a final order be passed in the first week of December, 2023; and (e) the question regarding the payment of salary and the benefits which Smt. Mamta Kumari claims to be accorded to her shall be considered in accordance with law.

Decision

10. With the aforesaid observations the writ petitions stand disposed off." 5. In response to the aforesaid order, the District Inspector of Schools had proceeded to pass the following order on 07.12.2023, the operative portion of which is reproduced as under:- "......> प्रबन्धक दद्वारद्वा शश्रीमतश्री ममतद्वा कक मद्वारश्री , प्रवकद्वा कद्वा ककयद्वा गयद्वा कनिलम्बनि तत्कद्वालश्रीनि जजिलद्वा कवदद्वालय कनिरश्रीक्षक बररेलश्री करे आदरेश कदनिद्वानांक 23.06.2023 दद्वारद्वा कनिलम्बनि अनिद्वानिकममोकदत कर कदयद्वा गयद्वा थद्वा। > कनिलम्बनि अनिद्वानिकममोकदत ककयरे जिद्वानिरे करे पश्चद्वात प्रबन्धक दद्वारद्वा मद्वानिनिश्रीय उच्च न्यद्वायद्वालय , इलद्वाहद्वाबद्वाद मम यद्वाकचकद्वा सनांख्यद्वा-16044/2023 कद्वालकद्वा प्रसद्वाद रद्वाम चन्द, कलद्वा करे न्द गरसर इण्टर कद्वालरेजि , बररेलश्री व प्रबन्धक बनिद्वाम उ०प्र० रद्वाज्य व 03 अन्य यमोजजित ककी गई एवनां शश्रीमतश्री ममतद्वा कक मद्वारश्री , प्रवकद्वा, दद्वारद्वा मद्वानिनिश्रीय उच्च न्यद्वायद्वालय, इलद्वाहद्वाबद्वाद मम यद्वाकचकद्वा सनांख्यद्वा -ए 16901/2023 यमोजजित ककी जजिसमम 01 अप्रप्रैल, 2022 सरे तदथर प्रधद्वानिद्वाचद्वायर वरेतनि ककी मद्वानांग ककी। उक दमोनिनों यद्वाकचकद्वाओनां कमो मद्वा० न्यद्वायद्वालय दद्वारद्वा सम्बद्ध कर , अपनिरे कनिररय कदनिद्वानांक 31.10.2023 करे दद्वारद्वा जजिलद्वा कवदद्वालय कनिरश्रीक्षक बररेलश्री कमो प्रकरर करे कनिस्तद्वारर हरेतक आदरेश पद्वाररत ककयरे गयरे। > सकचव, उत्तर प्रदरेश शद्वासनि करे पत्र सनांख्यद्वा-3203/15-8-2000/3227/90 कशक्षद्वा (8) अनिकभद्वाग लखनिऊ कदनिद्वानांक 25.10.2000 करे पप्रैरद्वा 07 मम प्रद्वाकवधद्वानि हप्रै कक "प्रवकद्वा पद पर कद्वायरभद्वार ग्रहर करनिरे वद्वालरे अध्यद्वापकनों ककी ज्यरेष्ठतद्वा उक पद पर कद्वायरभद्वार ग्रहर करनिरे ककी कतजथ सरे हश्री कनिधद्वारररत ककी जिद्वायरेगश्री। उनिककी पपूवर सरेवद्वाएनां स्निद्वातक शरेरश्री करे अध्यद्वापक करे रूप मम मद्वानिश्री जिद्वायरेगश्री, तथद्वा प्रवकद्वा पद कद्वा कद्वायरभद्वार ग्रहर करनिरे करे बद्वाद स्निद्वातक शरेरश्री ककी सरेवद्वाओ कद्वा कमोई लद्वाभ प्रवकद्वा पद करे चयनि / प्रद्वान्नकत वरेतनिमद्वानि कदयरे जिद्वानिरे हरेतक अनिकमन्य नि हमोगद्वा एवनां पप्रैरद्वा -8 मम- पदनिद्वाम पररवकतरत हमोनिरे करे फलस्वरूप यकद ककसश्री भश्री प्रकद्वार कद्वा कवत्तश्रीय भद्वार उत्पन्न हमोगद्वा तमो उसकद्वा वहनि रद्वाज्य सरकद्वार अथवद्वा कशक्ष कवभद्वाग करे मकख्यद्वालय दद्वारद्वा निहहीं ककयद्वा जिद्वायरेगद्वा और नि हश्री इस कवषय मम ककसश्री भश्री प्रकद्वार कद्वा अनिकदद्वानि ककसश्री भश्री शमोत सरे उपलब्ध करद्वायद्वा जिद्वायरेगद्वा" > मद्वाध्यकमक कशक्षद्वा अजधकनियम 1921 ककी धद्वारद्वा 16-छ (5) क.ख करे अन्तगरत प्रद्वावधद्वानि हप्रै कक ककसश्री सनांस्थद्वा कद्वा प्रधद्वानि यद्वा अध्यद्वापक प्रबन्धद्वाजधकरर दद्वारद्वा कनिलमम्बत निहहीं ककयद्वा जिद्वायरेगद्वा जिब तक कक प्रबन्धद्वाजधकरर ककी रद्वाय मम-(क) उसकरे कबरूद्ध आरमोप इतनिरे गम्भश्रीर नि हनों कक उससरे उसकमो पदच्यकत करनिद्वा, पद सरे हटद्वानिद्वा यद्वा पनांककच्यकत करनिद्वा, उकचत समझद्वा जिद्वाय, यद्वा (ख) उसकरे पद पर बनिरे रहनिरे सरे उसकरे कवरूद्ध अनिकशद्वासकनिक कद्वायरवद्वाहश्री करे सनांचद्वालनि मम बद्वाधद्वा पड़निरे यद्वा उनि पर प्रकतकपू ल प्रभद्वाव पड़निरे ककी सम्भद्वावनिद्वा हमो। कनिष्कषर मद्वाध्यकमक कशक्षद्वा अजधकनियम 1921 ककी धद्वारद्वा 16-छ (5) क.ख मम प्रद्वाकवधद्वाकनित व्यवस्थद्वानिकसद्वार शश्रीमतश्री ममतद्वा कक मद्वारश्री, प्रवकद्वा, करे ०पश्री०आर०सश्री० कलद्वा करे न्द गरसर इण्टर कद्वालरेजि , बररेलश्री पर लगद्वायरे गयरे आरमोपनों करे कवचद्वारमोपरद्वान्त कनिलम्बनि कद्वा अनिकममोदनि ककयद्वा जिद्वानिद्वा न्यद्वाय सनांगत निहहीं हप्रै। अततः उपरमोक आधद्वार पर शश्रीमतश्री ममतद्वा कक मद्वारश्री , प्रवकद्वा, करे ०पश्री०आर०सश्री० कलद्वा करे न्द गरसर इण्टर कद्वालरेजि , बररेलश्री कमो उ०प्र० मद्वा०कश० अजधकनियम 1921 करे अध्यद्वाय 3 ककी धद्वारद्वा 39 (3) करे उप कवकनियम 2 करे अन्तगरत प्रबन्धतन्त्र दद्वारद्वा शश्रीमतश्री ममतद्वा कक मद्वारश्री कद्वा मपूल प्रवकद्वा पद कद्वा कनिलम्बनि कदनिद्वानांक 05.06.2023 अनिद्वानिकममोकदत (Disapproved) ककयद्वा जिद्वातद्वा हप्रै और कवदद्वालय प्रबन्धक कमो कनिदरकशत ककयद्वा जिद्वातद्वा हप्रै कक वह तश्रीनि सदस्यश्रीय जिद्वाजाँच सकमकत गकठित कर, जजिसमम एक मकहलद्वा सदस्य कद्वा हमोनिद्वा अकनिवद्वायर हप्रै , शश्रीमतश्री ममतद्वा कक मद्वारश्री, प्रवकद्वा पर लगद्वायरे गयरे आरमोपनों ककी 03 मद्वाह करे अन्दर जिजॉच करद्वाकर जिजॉच आख्यद्वा इस कद्वायद्वारलय कमो उपलब्ध करद्वानिद्वा सककनिमश्चत करम।" 6. Thereafter, the Management of the College again sent a letter dated 5.6.2023 for suspension of respondent no.6, which was again disapproved by means of order dated 22.3.2024 by the District Inspector of Schools. After that the respondent no.6 was reinstated on the post of Lecturer and junior to her was made the Officiating Principal. Keeping in view the aforesaid disputes, the Joint Director, Education had constituted a three member Committee. The said Committee submitted its report dated 16.1.2024 to the Joint Director, Education in favour of respondent no.6. In view of the finding of the three member inquiry committee, the Director of Secondary Education has passed the order dated 20.05.2024 (impugned in the writ petition) directing the District Inspector of Schools to ensure handing over charge of the post of Officiating Principal to the respondent no.6 as before and to initiate proceeding under Section 16-D (3) (i) & (ii) against the Manager of the institution.The said order was approved by learned Single Judge. 7. Learned counsel for respondent no.6 has also vehemently opposed the special appeal and placed the order dated 18.07.2024, which is taken on record. He states that the management is flouting the orders of Authorities with impunity and as such no interference is required in the matter and the special appeal is liable to be dismissed. 8. After considering the submissions made by the learned counsels for the parties and upon perusing the impugned judgment and order, we notice that the same has been rendered by the learned Single Judge with cogent and justifiable reasons. In an Intra-Court Special Appeal, no interference is usually warranted unless palpable infirmities or perversities are noticed on a plain reading of the impugned judgment and order. In the facts and circumstances of the instant case, on a plain reading of the impugned judgment and order, we do not notice any such palpable infirmity or perversity. As such, we are not inclined to interfere with the impugned judgment and order. 9. In view of above, the special appeal sans merit and is, accordingly, dismissed. Order Date :- 31.8.2024 SP/
