This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
This is a bail application U/S.439 of Cr.P.C. by the petitioners for grant of bail arising out of Brahmanitarang P.S. Case No.162 of 2023 corresponding to G.R. Case No.680 of 2023 pending of the Court of learned J.M.F.C.(Rural), Rourkela for commission of offences punishable under Sections 395 of the IPC r/w Section 25/27 of the Arms Act, on the allegation of committing dacoity and looting cash from the possession of the informant by showing arms.
Heard, Mr. R. Prasad, learned counsel for the petitioners appearing virtually from Rourkela and Mr. S.R. Roul learned ASC in the present matter and perused the record.
After having considered the rival submissions and taking into consideration the nature and gravity of offences as alleged against the petitioner, so also the accusations sought to be brought against them and on going through the materials placed on record including the statement of some material witnesses, this Court is not inclined to grant bail to the petitioners. Hence, the bail application of the petitioners stands rejected. However, the petitioners may renew their prayer for bail after consideration of charge in the matter.
