#1. This matter is taken up through hybrid mode. 2. Heard learned counsel for the petitioners and learned Addl. Standing counsel for the State. 3. The petitioners are apprehending arrest in connection with Capital P.S. Case No. 651 of 2023 corresponding to C.T. Case No. 1830 of 2023 pending in the court of the learned SDJM, Bhubaneswar. 4. It is alleged that the petitioners and other co-accused persons wrongfully restrained the husband of the informant, abused him in obscene language and also assaulted him. It is submitted that a counter case has been registered at the instance of the wife of the present petitioners against the husband of the present informant.

Considering the nature of accusations and also the materials on record, while not being inclined to grant anticipatory bail to the petitioners, the ABLAPL is disposed of granting liberty to the petitioners to surrender before the court below within a week from the date of receipt of certified copy of this order and to move for bail. In such event, they shall be released on bail on such terms and conditions as the court below may deem fit and proper to impose. It is clarified that this order shall be operative only if the injury sustained by the injured is found to be simple in nature.
