This matter is taken up through hybrid arrangement.

In filing this Writ Petition, the Petitioner has sought for a direction from this Court to the Deputy Director, Nandankanan Zoological Park/Opposite Party No.3 releasing retirement benefits like gratuity and other benefits in her favour as per the provisions of the Payment of Gratuity Act, 1972, the order of the Government dated 14.12.2017/Annexure-2 and also the decision of the Supreme Court in the case of Netram Sahoo Vrs. State of Chhattisgarh.

Learned counsel for the Petitioner submits that even after the Signature Not Verified Digitally Signed Signed by: LITARAM MURMU Designation: Personal Assistant Reason: Authentication Location: OHC Date: 11-Dec-2024 11:51:12 death of the Petitioner’s husband on 21.01.2023 the above noted post retiral benefits including other service benefits have not been released in her favour till today. He further contends that 2 though the above noted benefits have already been released in favour of the other similarly situated persons, the Petitioner being a sexagenarian is still awaiting to get the said benefits.

At this juncture, learned counsel for the State, on instruction, submits that though the other post retiral benefits have already been released in favour of the Petitioner in the meantime, only the gratuity amount has not been released in her favour till today.

Considering the submissions made on behalf of both the parties, this Court directs the Deputy Director, Nandankanan Zoological Park/ Opposite Party No.3 to look into the matter and release the gratuity amount in favour of the Petitioner as per law within a period of three months from the date of presentation of an authenticated copy of this order.
