The Petitioner in this writ petition seeks to assail the order dated 25th September, 2025 passed by the Collector, Balangir- cum-Arbitrator under the National Highways Act, 1956 in Misc. Case No. 25 of 2024.

In course of hearing, Mr. Sukanta Kumar Mishra, learned counsel for the Petitioner submits that the Petitioner has a remedy under Section 34 of the Arbitration and Conciliation Act, 1996 (for brevity ‘the Act, 1996) to assail the order dated 25th September, 2025 under Annexure-8. Hence, he prays for withdrawal of the writ petition to avail the remedy under the Act,

1996.

Mr. M.K. Dash, learned Additional Standing Counsel does not have any objection to such prayer.
