Purna Chandra Sahoo v. State of Odisha & Ors.

Learned counsel appearing for the petitioner vehemently argues that the recognition & permission that have been issued under the statutory provisions in respect of the land are founded on a forged conveyance and therefore, his application for rescinding the same needs to be considered by OP No.3. He also draws attention of the Court to the provisions of compulsory Education Act, 2009 and rules promulgated thereunder in support of his contention. Having heard learned counsel for the petitioner and having perused the petition papers, this Court declines indulgence in the matter, inasmuch as whether the instrument or conveyance is forged or fabricated cannot be decided by the authorities constituted under the 2009 Act. Where a case of the kind is sought to be made out, a Writ Court cannot undertake a deeper examination of the same regard being had to the conventional limitation that have been operating since the advent of the Constitution. In the above circumstances, Writ Petition is disposed off with liberty to the petitioner to approach the appropriate forum for adjudication of the lis.
