Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is an accused in S.T. Case No.292 of 2021 pending on the file of learned Sessions Judge, Cuttack, arising out of Markatnagar P.S. Case No.96 of 2021 for commission of the offence under Section 302/498-A IPC.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned Sessions Judge, Cuttack, by order dated 27.07.2023 in the aforementioned case, the present BLAPL has been filed.
It is submitted by the learned counsel that in view of order dated 16.01.2023 passed in BLAPL No.232 of 2023, since the trial was not concluded within the time fixed by this Court, on the prayer of the learned Court in seisin time was extended and the same is likely to expire on 11.11.2023.
In such view of the matter, this Court is not inclined to entertain this bail application. Liberty is given to the Petitioner to renew his prayer at a later stage.
Accordingly, BLAPL stands disposed of. Learned Court in seisin is requested to expedite the trial since it is stated that 11 out of 21 charge sheeted witnesses have already been examined.
