I. FACTUAL MATRIX OF THE CASE: 2. The petitioner, on 26.7.1997, joined as Artist- cum- Modeler in M. K. C. G. Medical College, Berhampur through duly constituted Selection Committee and rendered his services under the control of the Opposite Party No.3. The post against which the petitioner was appointed was created in the year 1962 vide Govt. resolution dated 24.4.1962 which was communicated to all concerned by the Director of Health Services, Orissa vide his communication dated 30.4.1962. 3. Pursuant to an advertisement and consequent upon his selection through the Selection Committee, the petitioner joined against such vacancy in the year 1997. The nature and character of the said posts are that the incumbents would only be responsible to create / construct models or diagrammatic themes of various human organs and would further repair the existing models which have been either disfigured or defaced by efflux of time. Such posts are though non-teaching ones but play a vital role in imparting Medical Education and Training. 4. At the time of initial entry to the post though the petitioner joined as an Artist-Modeler, however, his scale of pay was fixed at a scale lower than that attached to the post of Artist- Signature Not Verified

More surprisingly his post was given the nomenclature of Artist-cum- Modeler. In fact a post of Artist was also at the S.C.B. Medical College, in its Department of Anatomy which was carrying a higher scale of pay than that of the petitioner. In order to have the discrepancy rectified and have the parity in scale of pay, the petitioner on 12.4.2002 through proper channel made a representation to the Opposite Party No.1 praying therein enhancement of pay scale in view of the Orissa Revised Scale of Pay Rule, inter alia praying for treating him as an Artist-Modeler instead of Artist- cum-Modeler on the ground that no such post of Artist- cum- Modeler was created for the Medical College in the year 1962. 5. When such representation was not considered, under constraints the petitioner on 5.2.2003 made a further representation to the Opposite Party No. 1 through proper channel by renewing his earlier grievance and prayer. The said representation was duly forwarded to the Opposite Party Nos.1 and 2 by the Opposite Party No.3 vide his communication dated 15.3.2003 with recommendation to consider the case of the petitioner. 6. After making necessary recommendation while forwarding the representation of the petitioner, when there was no clarification or communication from the Opposite Party No. 2, Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 3 of 18 the Opposite Party No.3 on 29.4.2003 made a further recommendation to the Opposite Party No.2 regarding enhancement of pay scale of the post of Artist-cum-Modeler inter alia requesting the Directorate to move the Govt. in its Health Department for according due approval and sanction. 7. The Opposite Party No.3 again on 11.8.2004 made another recommendation to the Opposite Party No.2 where in details of the discrepancy that is being observed in the case of the petitioner was clarified. The difference in scale of pay was also reflected inter alia the entitlement of the petitioner was clearly stated. Under such circumstances, the Directorate was requested to issue suitable instructions regarding permissibility as well as grant of higher scale of pay to the petitioner, i.e. Rs.4,750-7,500, instead of Rs.3,050-4,590 with effect from 1.1.1996. 8. Under such circumstances, the petitioner approached the Tribunal in O.A. No.2680 (C) of 2006 seeking therein for a declaration to the effect that the petitioner was appointed as Artist-Modeler which is at par with the post of Artist and with a further prayer to direct the Opposite Party Authorities to rectify the irregularity and grant all consequential service benefits including the benefits under the provisions of Orissa Revised Scale of Pay Rules as admissible to him, with effect from 1.1.1996. The Tribunal while disposing of the said Original Application No.2680 (C) of 2006, vide its Order dated 09.01.2007, directed the Opposite Party No.1 to respond to the communication of the Director within a time of two months from the date of communication of the order. The petitioner was further granted liberty to file fresh application if he continued to remain aggrieved. 10. Pursuant to disposal of the aforesaid Original Application, the Principal Secretary to Government vide its order dated 8.6.2007 intimated the petitioner that his claim for refixation of higher pay scale was examined and was found that the scale of pay which is claimed by the petitioner is attached to the post of Artist-cum-Draft The post of Artist-Modeler is distinct and separate from the post the petitioner holds and, thus, his claim merits no consideration. II. PETITIONER’S SUBMISSIONS: 11. Learned counsel for the Petitioner(s) earnestly made the following submissions in support of his contentions: 12. It was ascertained by the petitioner that the Director of Medical Education and Training (Opposite Party No.2) had made an enquiry and came to a definite conclusion that there has been an inadvertent mistake in giving a wrong nomenclature to the post of the petitioner. It was further observed by him that similarly placed incumbent at S. C. B. It was also held by him that the post against which the petitioner was appointed was of Artist-Modeler which in fact was created, but while issuing the appointment order wrongly Artist- cum-Modell or was reflected with a lower scale of pay. Under such circumstances, the Opposite Party No. 2 vide its communication dated 23.3.2005 requested the Opposite Party No.1 for issuance of appropriate orders so as to rectify the irregularity as well as grant of enhanced scale of pay. 13. The petitioner though was appointed as an Artist-Modeler, in the letter of appointment his post was reflected to be an Artist-cum-Modeler whereas such a post was not available to be filled up in the Department of Anatomy of the Medical College. Rather the Government created the post of Artist- Modeler in the year 1962. Such post was also created in the S.C.B. Medical College. But the irony is that while fixing the scale of pay, the pay scale attached to non-diploma holders even though the petitioner possess Diploma in the related discipline as well as the Degree, was sanctioned in favour of the petitioner. The said discrepancy which crept into the administration was inadvertent and the same has been continuing till date, putting the petitioner under much hardship. The petitioner is further aggrieved by the fact that Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 6 of 18 even though the Authorities are conscious and aware of such irregularity, the same has not yet been attended to thereby putting the life and livelihood of the petitioner in complete jeopardy. 14. By virtue of such discrimination, irregularities and illegality the Authorities have created a class within a class and the petitioner has been unlawfully discriminated. There has been no rationality in holding or treating the petitioner to be an Artist-cum- Modellor particularly when he performs the duties of an Artist- Modellor which is an admitted fact. On the other hand, when such a post was not available to be filled up, how the Authorities appointed the petitioner is an issue which needed judicial review. 15. The Opposite Party No. 1 while disposing the representation of the petitioner vis a vis the recommendation of the Opposite Party No. 2 has not considered the materials in its proper perspective rather has passed an order mechanically under misconception of facts. Therefore, the said order is not only arbitrary and illegal but also unsustainable in law. 16. The competent Authority has lost sight of the very aspect that in the year 1980 a Pay Rationalisation Committee was constituted to undertake a comprehensive review of the then existing scale of pay of the employees vis-a-vis rationalisation of the pay scales. The said Committee while submitting its Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 7 of 18 report in the year 1980 had categorically recommended that the incumbents holding the post of Artist- cum- Modeler or Artist-Modeler (as the case may be) would avail the revised scale of pay of Rs.370-670 if they have the Degree/Diploma qualification in the regard. The said Scale of Pay got revised to Rs.965-1710/- with effect from 1.1.1985, Rs.1400-2300/- with effect from 1.5.1989 and to Rs.4750/- to 7500/- w.e.f. 1.1.1996 under the O.R.S.P. Rules, 1998. Since the petitioner was appointed in the year 1997, his scale of pay should have been fixed at Rs.965-1710/- and he would have been eligible to receive the revised pay scale accordingly. However inadvertently while issuing the appointment order his scale of pay was wrongly mentioned at Rs.950 -1500/- as a result of which there has been such discrepancy. 17. Additionally, there is no hesitation to accept that the post of the petitioner carried a scale of pay of Rs.370 630/- if the incumbent did possess the Degree/Diploma qualification in the related field. The Opposite Party No.2 and 3 have categorically admitted such aspect and have further admitted that there has been an error apparent in the records, though inadvertent, regarding fixation of the scale of pay at the time of issuing the appointment order in favour of the petitioner in the year 1997. As a result, the impugned order suffers from legal as well as factual infirmities. 18. Moreover, the scale of pay of the employees fixed vide different ORSP Rules clearly disclose that the incumbents having technical qualification or Degree/Diploma qualification in the related field enjoy the privileges of higher scale of pay. The same is earmarked against Artist cum Draft- Artist Modeler and under the aforementioned Rules keeping in view the recommendations of the PRC (Pay Rationalisation Committee) there should not have been any bar or impediment on the part of the Authorities to fix the scale of the petitioner at Rs.4750 - 7500/- with effect from 1.1.1996 instead of Rs.3050-4590/-. Such aspect having not considered by the Opposite Party No.1, the orders passed by him is illegal and needs to be interfered with. 19. In spite of repeated request under the provisions of R.T.I. Act, 2005, the Authorities failed to provide the information regarding the creation of the post held by the petitioner and the copy of the letter No.6627/H dated 21.4.1962 has not been made available to the petitioner. Be that as it may, since the Authorities have admitted to the extent that the scale of pay of the petitioner should have been fixed at Rs.370-630/- as per 1981 ORSP Rules, there remains no further question to be settled and the petitioner is entitled to consequential revisions Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 9 of 18 on the said scale. Furthermore, the mistake having been pointed out needs to be corrected immediately and that being the settled position of law there should not be any other options left with the Authorities. 20. Accordingly, the Government having accepted the recommendations of the pay Rationalisation Committee and implemented the same for all the cadre of employees, there should not be any discrimination in the case of the petitioner. In that event the petitioner is being treated as an unequal amongst equals and has been subjected to remaining in a class within a class. Such discrimination is absolutely illegal and dehors the Rules. It seems that the petitioner has been a victim of circumstances and by virtue of such illegality the petitioner has suffered a great deal, both mentally and financially, as a result of which there has been serious dislocation in the family driving the petitioner into desperation. 21. Moreover, the petitioner is not only facing the ignominy of lower scale of pay than that has been fixed for the post but also illegal discrimination. Law is well settled that if a person is appointed against a particular post that has been created, wrong nomenclature or fixation of erroneous scale of pay cannot take away the entitlements of the incumbent as against the said post. Therefore, in the instant case, the petitioner is entitled to the revised scale of pay of Rs.4750-7500 attached to Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 10 of 18 the post of Artist-Modeler with effect from 1.1.96 instead of Rs.3050-4590 and the consequential benefits as well as the arrear differential salary. The authorities are aware of such fact and have admitted the irregularity. Thus, it was incumbent on their part to rectify the irregularity at the first instance. The same having been not done, the illegality warrants interference by the Tribunal. III. SUBMISSIONS OF OPPOSITE PARTY NO.3:

22. Per contra, learned counsel for the Opp. Parties intently made the following submissions: 23. The pay of the petitioner has been fixed at proper scale of pay under the rules as the petitioner has been rendering service as Artist-cum-Modeler as per the appointment order issued to the O.A. case by the Principal, M.K.C.G. Medical College, Berhampur. 24. The petitioner who has been appointed as Artist-cum- Modeler is practically sitting ideal without any work. He is neither creating diagrammatic things of various human organs nor repairing the scene which have been disfigured or defaced. 25. The petitioner has been appointed to this O.A. case as Artist- cum- Modeler with appropriate scale of pay in the month of July 1997. After receiving the said appointment order the petitioner did not raise any objection for the post of Artist- Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 11 of 18 cum-Modeler or for scale of pay. The representation vide Annexure-’2’ to O.A. case has been submitted to the Govt. health & family Welfare Department requesting to allow him the pay scale attached to the post of Artist-cum-Modeler has been disposed of since long on due consideration as the petitioner has been appointed Artist-cum-Modeler but not Artist Modeler. The representation said to have been submitted by the petitioner to the Govt. for allowing him pay scale of the post of Artist-Modeler has also been disposed of by Govt. in Health & F.W. Department. 26. The petitioner has been appointed as Artist-cum-Modeler in the scale of pay Rs.950-1500/- as per revised scale of pay rules- 1989 whose corresponding scale of pay comes to Rs.3050- 4590/-as per ORSP Rules, 1998. Thus, the recommendation, if any, made by the Principal, M.K.C.G. Medical College, Berhampur is purely erroneous as the scale of pay of Rs.4750- 7500/-relates to the post of Artist-Modeler and govt. in Health& F.W. Department. The O.A. has made it clear that the scale of pay of Artist-cum-Modeler comes to Rs.3050-4590/-as per ORSP Rules, 1998. The scale of pay Rs.4750-7500/-relates to the post of Artist-cum-Draft Artist Modeler. These two posts are completely different from each other. 27. Likewise the recommendation of the Principal, M.K.C.G. Medical College, Berhampur vide his letter dated 11.08.2004 Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 12 of 18 placed at Annexure -5 is wrong and erroneous because as per the subject of the said letter the request was for enhancement of pay scale of post of Artist-cum-Modeler being confused between the post of Artist-cum-Modeler and Artist-cum-Draft Artist Modeler such recommendation has been made by the principal only in the year 2007 the Government in Health & F.W. Department vide their letter dated 8.6.2007 placed at Annexure -10 to O.A case made it clear that there are two distinct posts namely Artist-cum- Modeler and Artist-cum Draft Artist Modeler carrying two distinct scale of pay while the petitioner has been appointed as Artist-cum-Modeler his scale of pay comes to Rs.3050-4590/- but not Rs. 4750-7500/-. 28. For M.K.C.G Medical College, Berhampur, the post of Artist- cum-Modeler has been created and against the said post the petitioner has been appointed and order to this effect has been communicated to the petitioner indicating there in the scale of pay as per ORSP-1989 Rules to which the petitioner did not object at any point of time till submission of representation for first time. Therefore, the recommendation made by the Principal, M.K.C.G. Medical College, Berhampur and as well as the letter of Director of Medical Education & Training Orissa vide Annexure-’6’ to the O.A case was finally examined

On due consideration of the qualification etc. of the petitioner the selection committee selected the petitioner for appointment as Artist-cum-Modeler for which post the petitioner had submitted an application. The petitioner might have higher educational qualification but that does not mean that he has to get higher scale of pay. 30. It is not a fact that there has been discrimination in the matter of fixation of pay in the post of Artist-cum-Modeler on due consideration of nature of duties meant for Artist-cum- Modeler, pay has been fixed in accordance with the provisions of the ORSP Rules, 1989. The Tribunal has disposed of O.A. case No.2680 (C) of 2006 on due consideration of the facts contained in said O.A. on referring to the relevant documents placed before the Tribunal with liberty to file a fresh application in case the petitioner is aggrieved by the order of Opposite Party-1 i.e. Government in Health & F. W. Department. 31. The petitioner got appointment in the year 1997 as Artist- cum-Modeler and the scale of pay as per ORSP Rules, 1989 has been allowed to him as per the order of appointment placed at Annexure-’7’ to the O.A. case. Once the appointment has been made on their basis of scale of pay prescribed in scale of pay rule- 1989, the petitioner cannot take advantage of Signature Not Verified Digitally Signed Signed by: BHABAGRAHI JHANKAR Designation: Assistant Registrar-cum-Senior Secretary Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 29-Sep-2023 15:30:22 Page 14 of 18 scale of pay applicable to the post of Artist-cum-Modeler prior to 1997. 32. With regards to the scale of pay as admissible for the post Artist-cum-Modeler, no discriminatory attitude has been shown to the petitioner while fixing the scale of pay on the basis of different ORSP, Rules by Govt. for the year 1974, 1981, 1989 and 1989 under said scale of pay Rules of different year there is no mention of scale of pay of Rs.370-630/-meant for Artist-cum-Modeler. IV. COURT’S REASONING AND ANALYSIS: 33. The Supreme Court held that opinions of expert bodies like Central Pay Commission, unless shown to be manifestly wrong, should not be interfered with and that it is not the nomenclature of a post but the qualitative and quantitative work performed by the holder of the post which has to be considered on the subject of parity in the pay scale. The Court can interfere when an individual misses out on the rightful scale of pay owing to the use of wrong nomenclature by the authorities. 34. The Supreme Court in the case of Dr. Kulbhushan Sehgal vs Union Of India &Ors.1 held that: “14. (2008) 5 SCC 173 and Secretary Finance Department and Ors. vs. West Bengal Registration Service Association and Ors. AIR 1992 SC 1203 to bring home the point that the courts should not interfere in fixing of the pay-scales as it is a specialised job assigned to the specialised bodies like Pay Commissions and merely on the ground the professional duties and responsibilities of two cadres are same, there is no ground to grant similar pay scales to two different sets of employees. This Court clarifies that the judicial review is done only to remove the typographical error and the disparity and the views of this Court are not being the Pay substituted Commission as the Pay Commission has missed out the pay scale of the Petitioners and gave wrong “Radiotherapy Technicians” as “Radiographer Technicians”. 16. The orders of the CAT dated 18th January, 2010 in OA No. 682/2009 and 28th April, 2010 in RA no. 108/2010 in OA No. 682/2009 are hereby set aside and it is hereby directed that the Radiotherapy Technicians be granted upgraded pay scale of Rs.5,000-8,000 w.e.f. 01.01.1996 on the same lines as was granted in the case of Radiographers. The consequential benefits be also granted to all the Petitioners. The order of the court be complied within eight weeks from the date of this order and the arrears be released within twelve weeks from today. Under such circumstances, the Opposite Party No.2 vide its communication dated 23.3.2005 requested the Opposite Party No.1 for issuance of appropriate orders so as to rectify the irregularity as well as grant of enhanced scale of pay. 36. The petitioner though was appointed as an Artist-Modeler, in the letter of appointment his post was reflected to be an Artist-cum-Modeler whereas such a post was not available in the Department of Anatomy of the Medical College. Rather, the Government created the post of Artist-Modeler in the year 1962. Such post was also created in the S.C.B. Medical College. In light of the aforesaid discussion and having regard to the present position of law, this Court is of the opinion that the post against which the Petitioner is rendering his services is equivalent to the post of Artist carrying a higher scale of pay. 38. Accordingly, this Writ Petition is disposed of being allowed. Judge ( Dr. S.K.
