Heard learned counsel for the petitioner and learned ORDER 03.08.2023 counsel for the State.
The petitioner is an accused in connection with G.R. Case No.624 of 2023, pending in the Court of the learned J.M.F.C (Cog. Taking), Talcher, arising out of Colliery P.S. Case No.280 of 2023, for commission of alleged offences under Sections 366/376(1)/506 of IPC.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Talcher by order dated 13.06.2023 in the aforementioned case, the present BLAPL has been filed.
It is submitted by the learned counsel that the petitioner is in custody since 31.05.2023.
Perused the 164 Cr.P.C. statement of the victim. Considering the nature of allegations, this Court is not
inclined to entertain the bail application at this stage.
Leave is granted to the petitioner to renew his prayer before the learned Court in seisin post charge sheet.
