#2. ORDER 21.07.2026 Heard learned counsel for the respective parties. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Motanga P.S. Case No.113 of 2026 corresponding to G.R. Case No.156 of 2026 pending in the file of learned J.M.F.C. (Cognizance Taking), Dhenkanal on the grounds stated.

#3. Perused the FIR as at Annexure-1. It is submitted to the Court that the petitioner has no other antecedent except the present one. In fact, the petitioner had earlier approached this Court in ABLAPL No.4672 of 2026 disposed of on 4th May, 2026 and it has been followed by the rejection order i.e. Annexure-2 of learned Sessions Judge, Dhenkanal. Recorded the objection of the State. The FIR i.e. Annexure-1 reveals that there is an allegation of illegal extraction of stone from a quarry but considering the claim that the petitioner has no other similar antecedent and a first-timer, this Court even if not in favour of entertaining his bail plea is inclined to direct him to surrender before the learned court below for being released with suitable conditions imposed.

#5. Accordingly, it is ordered. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C. (Cognizance Taking), Dhenkanal in connection with G.R. Case No.156 of 2026 corresponding to Motanga P.S. Case No.113 of 2026 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by learned court below as deemed just and proper in the facts and circumstances of the case.
